2. In this act, the following expressions mean:(1) “alcohol” : the product of distillation of any fermented liquid, whatever its origin, rectified once or oftener, also synthetic ethyl alcohol and alcohol which is considered non-potable under customs laws;
(2) “amphitheatre” : an establishment comprising stepped rows of seats and an arena disposed so as to allow the presentation of a match or spectacle;
(3) “reunion” : a gathering at which alcoholic beverages are served or sold;
(4) “beer” : the beverage obtained by the alcoholic fermentation in drinking water of an infusion or decoction of barley malt, hops or any other similar product;
(5) “alcoholic beverages” : the five varieties of beverages defined in this section, namely: alcohol, spirits, wine, cider and beer, and every liquid or solid containing alcohol, spirits, wine, cider or beer and capable of being consumed by a human being. Any liquid or solid containing more than one of the five varieties above mentioned is considered as belonging to that variety which has the higher percentage of alcohol, in the following order: alcohol, spirits, wine, cider and beer;
(6) “bedroom” : a room specially arranged to accommodate one or more travellers and provided with at least one window, its door opening into a closed or open passage used to connect the rooms with each other and with the remainder of the establishment;
(7) “cider” : the beverage obtained by the alcoholic fermentation of apple juice and containing at least two and one-half per cent and not more than thirteen per cent of alcohol by volume;
(8) “strong cider” : cider containing more than seven per cent and not more than thirteen per cent of alcohol by volume;
(9) “weak cider” : cider containing from two and one-half to seven per cent of alcohol by volume;
(10) “to peddle” : to carry alcohol, spirits, cider, wine or beer on one’s person or to transport it with one, or with the aid of another person, with intent to sell it outside any establishment where the sale thereof is allowed;
(11) “Commission” : the Commission de contrôle des permis d’alcool du Québec constituted by section 3;
(12) “corporation” : any public or private corporation;
(13) “establishment” : any premises where a permit is in use or where alcoholic beverages are manufactured under any act of the Parliament of Canada;
(14) “hotel” : any establishment specially arranged to habitually provide, in consideration of payment,food and lodging to travellers, having a sufficiently equipped kitchen and a dining-room where meals can be served at one time to at least as many persons as there are bedrooms in the hotel, in the case of an establishment of less than one hundred bedrooms, or to a number of persons equal to one-half of the number of bedrooms, in the case of an establishment of one hundred bedrooms or more, provided in such latter case that the minimum capacity of the dining-room is not less than one hundred persons; such an establishment also has at least the following number of bedrooms available to travellers:(a) in Montréal or Québec, thirty;
(b) in another city or in a town, ten;
(c) elsewhere, six;
(15) “holiday” :(a) Sundays;
(b) New Year’s day;
(c) Good Friday;
(d) Christmas day;
(16) “disorderly house” : a disorderly house within the meaning of Part V of the Criminal Code;
(17) “motel” : any establishment specially arranged to provide the traveller, in consideration of payment, with food and lodging, and composed of independent and contiguous units to which the traveller has access from outside, and which comprises at least the following number of bedrooms availabe to travellers:(a) in Montréal or Québec, thirty;
(b) in another city or in a town, ten;
(c) elsewhere, six;
(18) “permit” : any permit the issuance of which is authorized by this act;
(19) “person” : a physical person, corporation, partnership or club;
(20) “race-track” : a piece of ground specially laid out for horse races, automobile races or other kinds of races;
(21) “apple-grower”: every physical person who cultivates apple trees in Québec;
(22) “population” : the number of inhabitants in a municipality as shown in the last census made for the whole of Québec or the municipality and recognized as valid for the purposes of this act by the Gouvernement;
(23) “whosoever” : the offender as well as his mandatary, representative and any person under his control;
(24) “Corporation” : the Société des alcools du Québec;
(25) “general manager” : the general manager of the Corporation;
(26) “meal” : food sufficient to constitute a person’s lunch or dinner;
(27) “residence” : the room or group of rooms comprising the dwelling of a person, including the basement;
(28) “secretary-general” : the secretary-general of the Commission de contrôle des permis d’alcool appointed under section 36;
(29) “spirits” : any beverage which contains alcohol mixed with drinking water and other substances in solution, and includes, among other things, brandy, rum, whiskey and gin;
(30) “theatre” : an establishment arranged so as to allow the presentation of a concert or spectacle on a stage;
(31) “vehicle” : anything used for transportation;
(32) “to sell” : with reference to anything forbidden by this act:(a) to solicit or receive an order for alcoholic beverages;
(b) to keep or expose them for sale;
(c) to deliver them for value or otherwise than gratuitously;
(d) to deliver them, even gratuitously, in a disorderly house;
(e) to peddle them;
(f) to keep or possess them with intent to sell them;
(g) to keep or possess them in violation of section 91 or transport them in violation of sections 92 to 95;
(h) to traffic in them;
(i) to procure them for or allow them to be procured by another person, for any consideration promised or obtained directly or indirectly and on any pretext or by any means whatsoever;
(33) “wine” : the alcoholic beverage obtained by the fermentation of grape juice, the juice of other fruits or vegetable products or of honey; this word does not include cider;
(33.1) “designated wines” : the wines the Corporation designates by virtue of subparagraph a of section 37.1 of the Act respecting the Société des alcools du Québec (chapter S-13);
(34) “traveller” : a person who, in consideration of a given price per day or fraction of a day, on the American or European plan, or per meal, à table d’hôte, or à la carte, is furnished by another person with food or lodging or both;
(35) “division” : any region of Québec determined by the Gouvernement by an order published in the Gazette officielle du Québec.
