Regulation respecting the conditions for the sale of medications in an institution
Pharmacy Act
(chapter P-10, s. 37, par. b).
1. An institution to which a pharmacist or physician is attached may sell or supply medication to persons not admitted or registered there on condition that within 33 km of such institution:
(1)  there is no pharmacist or physician practising pharmacy on his own account;
(2)  there is no other institution which sells or supplies medication under this Regulation.

2. The decision of an institution governed by section 1 to act under this Regulation is made by resolution of its board of directors.

3. The institution must notify the Ordre des pharmaciens du Québec of its decision by registered or certified mail.
The notice must contain the name and home address of the pharmacist or physician attached to the institution.

4. As soon as it is notified that a pharmacist intends to practise pharmacy on his own account within 33 km of the institution, the Ordre des pharmaciens du Québec must notify the institution by registered or certified mail.
Such notice must inform the institution of the date of the beginning of practice of the pharmacist, and as soon as he begins practice the institution must stop selling or supplying medication under this Regulation.

5. For the purposes of sections 1 and 4, the radius of 33 km is computed on the basis of roads open to traffic.
