1817. A gift made to the owner, a director, an operator, a person responsible or an employee of an institution, of another lodging facility or of a residence within the meaning of the laws relating to health and social services, or to a person who carries on remunerated or non-remunerated activities there, is without effect if it was made while the donor was receiving care or services there, unless the donee is also the spouse or a close relative of the donor.
A gift made to a member of a foster family while the donor was residing with that family is also null.

1817. A gift made to the owner, a director or an employee of a health or social services establishment who is neither the spouse nor a close relative of the donor is null if it was made while the donor was receiving care or services at the establishment.
A gift made to a member of a foster family while the donor was residing with that family is also null.
