46. A person who attained 65 years of age before 26 June 1986 and who transferred his years or parts of a year of service credited under the Government and Public Employees Retirement Plan, the Teachers Pension Plan or the Civil Service Superannuation Plan to the pension plan of a body with which an agreement has been entered into under section 158 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) is entitled to receive, if section 12 of the Act respecting pension coverage for certain teachers (chapter P-32.1) was applicable to him, instead of the pension credit under the said section 12, the amount computed in accordance with sections 40 and 41 of this Act as though they had been in force on the person’s sixty-fifth birthday. If the person referred to in the first paragraph died before 26 June 1986 and was 65 years of age or older, the first paragraph applies to the amount payable to the spouse or, as the case may be, to the guaranteed benefit according to the election made by the person under section 18 of the Act respecting pension coverage for certain teachers.
