118. If a marketing board or a person or partnership subject to a plan refuses without due cause, in the opinion of the Régie, to negotiate the terms and conditions relating to the production or marketing of the product marketed under a plan, to appear for or participate in conciliation or arbitration after being called for such purpose, or to sign an agreement the terms of which it or he does not contest, the Régie may, after giving the interested parties the opportunity to present observations, prescribe the terms and conditions relating to the production and marketing of the product. The Régie may then, at the request of one of the interested parties, exercise the powers set out in section 117.
The decision of the Régie is in lieu of and has the same effects as an arbitration award.
