232.4. A person referred to in the first paragraph of section 232 must, in accordance with the standards established by regulation, provide and maintain a guarantee covering the anticipated costs for carrying out the rehabilitation and restoration work and for the follow-up to the work, as determined in the plan.

Where the guarantee is property or a sum of money, the property or money is exempt from seizure.

232.4. A person identified in section 232.1 must furnish a guarantee covering the anticipated cost of completing the work required under the rehabilitation and restoration plan to the extent provided for in this Act and in accordance with the standards established by regulation.

Such work must include

(1)  the rehabilitation and restoration of accumulation areas;

(2)  geotechnical soil stabilization;

(3)  the securing of openings and surface pillars;

(4)  water treatment; and

(5)  road-related work.

Where property or a sum of money serves as guarantee, the property or money is exempt from seizure.

232.4. The rehabilitation and restoration plan must include a description of the guarantee serving to ensure performance of the work required by the plan. The description must meet the standards prescribed by regulation as to its term, form, amount and conditions.

Where property or a sum of money serves as guarantee, the property or money is exempt from seizure.
