1775. Where the buyer has observed the prescribed formalities, the creditors of the seller have no right or remedy against the buyer or against the sold property but they retain their remedies against the seller.
If the creditors of the seller are prior or hypothecary creditors and have not participated or have participated only partially in the distribution, they retain the right to exercise the rights and remedies granted to them by law.
