1289. The rights of the beneficiary of a personal trust, if he is not yet conceived, are exercised by the person who, having been designated by the settlor to act as curator, accepts the office or, failing him, by the person appointed by the court on the application of the trustee or any interested person. The Public Curator may be designated to act.
In a private trust of which no person, even determinable or future, may be a beneficiary, the rights granted to the beneficiary under this subsection may be exercised by the Public Curator.
