39. Where the witness summoned is a person in detention, the most senior officer of the institution referred to in article 7, of the detention centre or of the penitentiary must ensure that he is brought to the place indicated in the summons at the date and time indicated therein.

Where the witness summoned is a person in detention, the director of the facility maintained by an institution referred to in article 7 or the director of the correctional facility or penitentiary must ensure that he is brought to the place indicated in the summons at the date and time indicated therein.
