Regulation respecting the artificial inducement of rain
Act respecting the artificial inducement of rain
(chapter P-43, s. 11).
1. In this Regulation,
(a)  “certificate” means the qualification certificate provided in sections 2, 4, and 5 of the Act respecting the artificial inducement of rain (chapter P-43);
(b)  “authorization” means the special authorization of the Minister provided in section 7 of the Act respecting the artificial inducement of rain;
(c)  “Minister” means the Minister of Sustainable Development, Environment and Parks.

DIVISION I
CERTIFICATE
2. The qualification certificate may be granted only to a graduate from any recognized university with a degree in applied sciences who majored in meteorology as far as master’s or doctor’s degree, or any partnership or legal person having at least one graduate meteorologist in its employ. A study certificate of the university where such person graduated or an attestation of a consultant meteorologist of the American Meteorological Society shall be annexed to the application for certificate.

3. An application for a certificate shall be made on the form prescribed in Schedule A.

4. Every certificate shall be dated the day of its issuance and valid for a period of 12 months.

5. Any person holding a certificate and wishing to maintain the same in force shall apply for the renewal thereof to the Minister not later than 30 days before its expiration.

6. The certificate shall cost $50 for the first year. The renewal of a certificate shall be $25 per year.

7. Subject to section 13 of the Act, any certificate may be cancelled:
(a)  if the body or company holding a certificate has not the assistance of a graduate meteorologist for a period of more than 2 months;
(b)  if the certificate was obtained through fraud or misrepresentation;
(c)  if the body or company holding a certificate fails to supply the Minister with its operation and result valuation reports within the required time.

DIVISION II
AUTHORIZATION
8. No application for authorization is granted to anyone but the holder of a certificate in force.

9. An application for authorization shall be made on the form prescribed in Schedule B.

10. The application for authorization shall contain:
(a)  the reasons for which the applicant wishes to engage in operations to induce rain artificially;
(b)  the identification, by means of a map with a scale of at least 1:500 000, of the zone being the subject of the operations (target-zone);
(c)  the period and duration of the operations for which authorization is applied for;
(d)  the description of the means to be used to induce rain artificially, of the instruments, their operation system and location;
(e)  a statement on the number of instruments the use of which is required.

11. Subject to section 10 of the Act, any person applying for authorization shall prove to the satisfaction of the Minister that he has published in newspapers the notices required by section 8 of the Act.

12. A person applying for authorization shall prove to the satisfaction of the Minister that he is the holder of a civil liability insurance policy of at least $500,000.

13. The holder of a certificate having been granted the authorization to induce rain artificially shall submit to the Minister a quarterly report of operation to describe:
(a)  the equipment used;
(b)  the areas effectively affected by the system of artificial inducement of rain;
(c)  the dates and the number of hours during which the system has effectively been applied.
If the operation lasts for less than 3 months, the holder of a certificate who was granted the authorization to induce rain artificially shall submit his report within one month after the end of the operations.

14. The holder of a certificate who was granted the authorization to induce rain artificially shall submit to the Minister, before 31 March of each year, a quantitative valuation report on the results of the operations of the preceding year by complying with the valuation system given in the authorization.

15. When the holder of a certificate is a legal person or partnership, the operation and valuation reports shall be signed by a meteorologist in the employ of such legal person or partnership.

Delimitation of the target-zone on a map 1:500 000, mode of operation, how many instruments, their system of operating and location.

We agree to supply the Service de météorologie of the Ministère du Développement durable, de l’Environnement et des Parcs a quarterly report of operation and annual report to reckon the results of our program to induce rain artificially based on the statistic method recommended by the Minister.
We certify to the Minister of Sustainable Development, Environment and Parks that we are willing to cooperate fully to facilitate for the personnel of the Service de météorologie the inspection at any time of the instruments which we use for the purposes of inducing rain artificially and verify the procedures which we follow to carry on the operation.
