Regulation respecting the sale of livestock by auction
Animal Health Protection Act
(chapter P-42, s. 45).

DIVISION I
DEFINITIONS
1. In this Regulation, unless the context indicates otherwise,
(a)  “Act” means the Animal Health Protection Act (chapter P-42);
(b)  “Minister” means the Minister of Agriculture, Fisheries and Food;
(c)  (paragraph revoked).

DIVISION II
PERMIT
§ 1.  — Permit
2. Permit application: An application for a permit to operate an establishment under section 31 of the Act must be made to the Minister in the form in Schedule 1 and include the documents prescribed in the Schedule.

3. Plans and specifications: An application for a permit must include scale plans of the establishment, its outbuildings and the ground on which they are built and specifications indicating:
(a)  their siting in relation to the contiguous lots;
(b)  the size, arrangement and installations of the rooms and areas of the establishment and the outside area for the dumping of soiled bedding;
(c)  the size and location of partitions, doors, windows, stairs, pillars and stationary equipment;
(d)  the description and nature of the drinking water, hot water, lighting and ventilation systems; and
(e)  the nature of the materials used for the exterior facing of the building.

3.1. Compliance of the establishment: The applicant must show to the Minister that the organization of the establishment complies with the prescriptions of sections 19 to 29.

4. Authorizations: The applicant must include with his application for a permit the authorizations issued respectively by the Commission de protection du territoire agricole du Québec and the interested municipality to the effect that the location of his establishment is in conformity with the Act respecting the preservation of agricultural land and agricultural activities (chapter P-41.1) and with the municipal zoning by-laws.

5. Permit renewal: The Minister shall, on the same conditions, upon receipt of an application for the renewal of a permit submitted to him in due form by a permit holder in the form in Schedule 2, renew his permit provided the applicant continues to meet the requirements of the Act and the Regulation and reports, where applicable, any change relative to information and documents furnished in compliance with sections 2 to 4.

6. Application for renewal of a permit: The application for renewal of a permit must be made and received by the Minister at least 60 days prior to the date of expiry of the permit.

7. Return of permit: In case of suspension, cancellation or non-renewal of his permit, the operator must return it to the Minister.

8. Content of permit: The permit must be drawn up in the form in Schedule 3.

9. Discontinuance or suspension of operations: Every operator must notify the Minister without delay if he ceases his operations or suspends them for the period of time which he indicates. If he resumes his operations while his permit is still in force, he must also inform the Minister thereof without delay.

10. Exception: The operator may not hold nor have an interest in a permit prescribed in section 9 of the Food Products Act (chapter P-29).

11. Prohibition to issue a new permit: Every person whose permit was cancelled may not submit a permit application until the expiry of 12 months following such cancellation.

12. Change — modification: Each time a change or a modification occurs regarding any of the information prescribed in the form in Schedule 1 and in section 3, the operator must inform the Minister thereof not later than 15 days following such change or modification.

14. Fees for a permit: Fees payable for the issue or renewal of a permit for operating an establishment are $440 per year.
The fees provided for in the first paragraph shall be indexed on 1 April of each year on the basis of the rate of increase in the general Consumer Price Index for Canada for the 12-month period ending on 30 September of the preceding year, as determined by Statistics Canada.
The fees indexed in the prescribed manner shall be reduced to the nearest dollar where they contain a fraction of a dollar less than $0.50; they shall be increased to the nearest dollar where they contain a fraction of a dollar equal to or greater than $0.50.
The Minister shall inform the public, through Part 1 of the Gazette officielle du Québec or by such other means as he considers appropriate, of the indexing calculated under this section.

DIVISION III
PREMISES AND ORGANIZATION OF ESTABLISHMENTS
§ 1.  — Standards of construction and equipment
19. Installation: An establishment must have a supply of hot and cold drinking water and lighting of at least:
(a)  50 decalux, 1 m above ground in the locations referred to in paragraphs a, b, d and f of section 20; and
(b)  20 decalux, 1 m above ground in the locations referred to in paragraphs c, e and g of section 20.
All pens must be large enough so that animals may lie down without being overcrowded. Large animals must be separated from small ones.
The compartments and all the equipment which may come into contact with the animals must be designed to prevent falls and injuries.

20. Compulsory facilities: An establishment, its outbuildings and the ground on which they are located must include the following facilities:
(a)  a receiving area;
(b)  an examination and detention pen;
(c)  a pre-sale pen;
(d)  a sale area;
(e)  an accommodation area for animals before shipping;
(f)  a shipping area;
(g)  separate storage areas for new bedding and for feed required to feed the animals staying in the establishment;
(h)  a storage area for soiled bedding set up in accordance with the Regulation respecting the prevention of water pollution in livestock operations (R.R.Q., 1981, c. Q-2, r. 18);
(i)  an office reserved exclusively for the inspector; and
(j)  wash basins and lavatories for use by the personnel and the public, separate for men and women.

21. Cleanliness: The operator must ensure that his personnel is clean and that the rooms and equipment of his establishment are kept clean.

22. Installation of receiving area: The receiving area must meet the following conditions:
(a)  it must be provided with a concrete platform at least 60 cm high that is designed to facilitate unloading operations and capable of receiving all kinds of vehicles transporting animals;
(b)  the floor must be non-slippery;
(c)  the platform used for the arrival and departure of animals must be covered; and
(d)  it must permit a brief examination of animals at the time of arrival.

23. Installation of examination and holding pen: The examination and holding pen is reserved for the examination and holding of every animal appearing to be diseased or injured at the time of arrival. It must meet the construction requirements prescribed in section 24 for the pre-sale pen.

24. Installation of pre-sale pen: The pre-sale pen must allow for the separation of the various species of animals and meet the following requirements:
(a)  it must have a concrete floor; and
(b)  its walls and partitions must not be rough.

25. Installation of sale area: The sale area must have a set of scales, a sale arena and stepped rows of seats for the public.

26. Installation of accommodation pen for animals before shipping: The accommodation pen for animals before shipping must meet the construction standards of the pre-sale pen and in addition it must be equipped with drinking facilities and feeding troughs.

27. Installation of shipping area: The shipping area must be installed in the same manner as the receiving area so as to permit the loading and handling of animals.

28. Compulsory equipment: The establishment must include the following equipment:
(a)  appliances for scraping and disinfecting the surfaces of the facilities referred to in paragraphs a to g of section 20;
(b)  appliances for cleaning vehicles and equipment used for the transport and unloading of animals;
(c)  emergency exits, fire extinguishers as well as lights indicating emergency exits;
(d)  a heating and ventilation system; and
(e)  a set of scales for weighing animals.

28.1. Scraping and soiled bedding: The operator must ensure that the surfaces of the facilities referred to in paragraphs a to g of section 20 and with which the animals come into contact must, after each auction, be scraped so as to be free from any organic waste and soiled bedding.
He must also ensure that the soiled bedding, after being scraped, is placed in the storage area provided for in paragraph h of section 20.

28.2. Disinfection after scraping: The operator must ensure that the surfaces referred to in the first paragraph of section 28.1, after being scraped, are treated with a disinfectant so as to prevent the multiplication of pathogenic microorganisms.

29. Set of scales: The set of scales must meet the following requirements:
(a)  it must be provided with a main readout to allow the operator and any interested party to read and compare the weight measured and that indicated on a secondary readout consisting of the information board;
(b)  it must be located in the sale area in public view, to allow anyone watching the information board to see the weighing platform of the scale and at the same time to read the weight indicated on the board;
(c)  it must be equipped with a weight card printer giving the weight, date and time of the weighing;
(d)  before each weighing, the main readout of the scales must show the figure 0 when no animal is on the weighing platform;
(e)  the balancing weights and the readout of the scales must come back automatically to their point of balance;
(f)  it must be equipped with a weighing platform having a pen with a surface area of at least 2 m2;
(g)  it must have an automatic movement detector that prevents operation of the printer until the weight readout is completely stabilized on the main readout;
(h)  it must be equipped with a dampening mechanism to minimize oscillations and to stabilize the weighing platform;
(i)  it must have no beam or any other unprotected outside device; and
(j)  it must comply with the Weights and Measures Act (R.S.C. 1985, c. W-6) and with the Weights and Measures Regulations (C.R.C., c. 1605).

§ 2.  — Standards of operation/Registers and reports
30. Insurance: The operator must insure and maintain insured against fire every animal kept in his establishment with full coverage in the case of loss.
At the time of application for or renewal of a permit, he must file with the Minister a certificate of the insurance prescribed in the first paragraph.

31. Working hours: The operator must furnish to the Minister a schedule indicating the time of opening and receiving animals in his establishment. If the schedule is modified, the operator must notify the Minister thereof without delay. It must be posted up in the establishment.

32. Landing bill: Upon receiving animals, the operator shall complete a landing bill, in duplicate, giving the date, name and address of the seller, the number and categories of animals, their identification number and, where applicable, the name of the carrier.
The operator shall keep a copy thereof and give the other to the person who has made the delivery.

33. Weight card: The operator must ensure that the weight card is completed in triplicate on a form containing all the particulars in Schedule 5.
The operator shall keep a copy thereof and give one to the purchaser and the other to the seller.

33.1. Weight result: The operator must ensure that the weight result indicated on the information board corresponds to that on the main readout that is printed on the weight card by the printer.
As soon as the result is printed on the weight card, he must ensure that the weight indicated on the information board corresponds to the result printed on the card.
He must also ensure that the weight of the animal offered for sale in the sale arena remains on the information board in public view until the auctioneer has completed the sale.

34. Register of consignments: The operator shall keep a register of consignments in the form in Schedule 6.

38. Keeping of documents: The operator shall keep the following documents:
(a)  his registers and landing bills, by order of date, for at least 2 years from the date of the last entry or the date they were filled in;
(b)  his invoices, by numerical order for at least 2 years from the date on which they were made; and
(c)  the weight cards, by numerical order for at least 1 year from the date of the weighing.

40. Prohibited sale of animals: No person may sell in an establishment an incurable animal or an animal affected with a contagious disease and declared as such by a veterinary surgeon inspector at the time of entry of such animal in the establishment.
The animal is then seized by such inspector and directed to a slaughterhouse where a release is granted depending on the results of the ante mortem or post mortem examination.
If such animal cannot be slaughtered in a slaughterhouse, it must be slaughtered by its owner and directed to a dismembering plant where a release is granted.

41. Animal suspected of being diseased: Every animal suspected of being diseased or that is found to be injured following a visual examination carried out by an inspector at the time of its arrival in an establishment must be directed to the examination and detention pen for examination by a veterinary surgeon inspector before the auction.
Where the animal is found by the veterinary surgeon inspector to be diseased, but not in a condition contemplated by section 40, it must be seized by such inspector, sold as such and, after its sale, directed to the slaughterhouse where a release is granted depending on the results of the ante mortem or post mortem examination.

42. Record of sick animals: The operator must keep a record of the animals described in section 41 giving the name of the animal’s owner, the name of the buyer, the place where it will be slaughtered and the identification number of the animal.

43. Exclusivity of documents: The documents prescribed in sections 32, 33 to 35 and 45 must be used exclusively for auctions.

44. Purchase restriction: The operator of an establishment, the auctioneer or any person representing or acting directly or indirectly on behalf of or for the benefit of one of them, may not raise the price nor act as a purchaser at an auction held therein.

44.1. Number of bids: The operator must ensure that the auctioneer of the establishment receives at least 2 bids before completing the sale.

45. Invoices: The operator shall, upon paying the seller, fill out, in duplicate, an invoice stating the date, name and address of the seller, the number of animals and their categories, the identification number of the animals, the purchase price and the amount paid to the seller.
The operator shall keep a copy thereof and give the other to the seller.

46. Table of commissions: The operator must post up in public view a table of the rates of commission per category and forward a copy thereof to the Minister. Any modification to the rates must be forwarded to the Minister before coming into force.

DIVISION IV
INSPECTION AND ENFORCEMENT
53. An authorized person who witnesses an offence against Division IV of the Animal Health Protection Act (chapter P-42) or against this Regulation must immediately draw up an offence report complying with the Regulation respecting the form of offence reports (chapter C-25.1, r. 2).

54. An authorized person must affix a numbered and dated slip on every dead or alive animal, product, object or lot seized or confiscated under Division IV.2 of the Animal Health Protection Act (chapter P-42). In addition to the authorized person’s signature, such slip must bear the particulars indicated in either of the models in Schedule 8.
Notwithstanding the foregoing, when a live or dead animal or a lot of such animals is seized or confiscated, the authorized person may place the slip on the enclosure containing the animals. In all cases, the person must identify each animal by means of a numbered, adjustable and non-reusable clip bearing the indication “seized” or “confiscated”, as the case may be.
Actions taken in respect of a seizure or confiscation must be recorded in minutes dated and signed by an authorized person and containing the particulars indicated in the model in Schedule 9.

55. Release from seizure must be granted in writing by any authorized person where any of the situations provided for in section 55.20 of the Animal Health Protection Act (chapter P-42) occurs or where the seized items must be returned under another Act.
Such release must be dated and signed by the authorized person and must bear the particulars indicated in the model in Schedule 10.

56. Every taking of samples must give rise forthwith to the drawing-up of minutes, which must be dated and signed by an authorized person. Such minutes must contain the particulars indicated in the model in Schedule 11.
Seals must be affixed to the sample container. Each sample must be identified by a numbered tag bearing the particulars indicated in the model in Schedule 12.
Notwithstanding the foregoing, where the sample is a live or dead animal, the authorized person must identify the animal by means of a numbered, adjustable and non-reusable clip, unless such a clip was affixed when the animal was seized.
The actions prescribed in this section must be mentioned in the minutes.

57. All minutes must be drawn up in triplicate in accordance with the model in Schedule 9 or 11, as the case may be.
The first copy must be forwarded by the authorized person with 24 hours to the Ministère de l’Agriculture, des Pêcheries et de l’Alimentation. A copy must be left with the owner or person having possession of the samples taken or the items seized, destroyed or confiscated, or with his representative, or with the person having custody of the items seized or confiscated and, where applicable, with the representative of the carrier. A copy must be kept by the authorized person.

58. Any sample taken must be placed under seal and sent, together with the minutes, to the Ministère de l’Agriculture, des Pêcheries et de l’Alimentation. If the nature of the sample is such that special preservation measures are required, the sample must be sent immediately to the laboratory where such measures must be taken. Such sending must be mentioned in the minutes.

58.1. Within 24 hours of its receipt by the department, the sample must be forwarded to the laboratory.
Within 8 days of receiving the sample or within the additional time period required to complete the analysis, the laboratory must send to the department a report containing the particulars indicated in the model in Schedule 13.

59. Penal provision: Every person who contravenes sections 7, 9, 12 or 19 to 46 commits an offence and is liable to the penalties prescribed by section 55.44 of the Act.

— This permit authorizes its holder to operate his business in accordance with the Animal Health Protection Act (chapter P-42).
— The application for renewal must be received by the Minister 60 days before the expiry of the present permit.
— This permit is personal and may therefore not be transferred to another person.
— In the case of an offence or failure to comply with the conditions for issuance, this permit may be suspended, cancelled or not be renewed.
— In the case of cancellation, a new permit shall not be issued before the expiry of 12 months thereafter.
— In one or other of these cases, the holder will be heard before the Minister decides on the matter.
