Regulation respecting threatened or vulnerable plant species and their habitats
Act respecting threatened or vulnerable species
(chapter E-12.01, ss. 10, 16, 17 and 39).

DIVISION I
GENERAL
1. For the purposes of this Regulation, all the specimens of a plant species that grow naturally in their native habitat constitute a wild population.
No human intervention, including transplantation into a host environment, may operate to destroy the fundamental nature of a wild population or of a specimen of a wild population.

DIVISION II
THREATENED PLANT SPECIES
2. The following are designated as threatened plant species:
— American ginseng (Panax quinquefolius Linnaeus) as regards its wild populations;
— American water-willow (Justicia americana (Linnaeus) Vahl);
— autumn coralroot (Corallorhiza odontorhiza (Willdenow) Poiret var. odontorhiza);

4. Despite the prohibitions referred to in section 16 of the Act respecting threatened or vulnerable species (chapter E-12.01), a person may have wild leek (Allium tricoccum Aiton) in his or her possession outside its natural environment or may harvest it for the purposes of personal consumption in an annual quantity not exceeding 200 g of any of its parts or a maximum of 50 bulbs or 50 plants, provided that those activities do not take place in
— a park within the meaning of the Parks Act (chapter P-9);
— an area or natural setting designated under the Natural Heritage Conservation Act (chapter C-61.01);
— a wildlife preserve within the meaning of the Act respecting the conservation and development of wildlife (chapter C-61.1);
— a site acquired under section 8 of the Act respecting threatened or vulnerable species;
— a regional park within the meaning of section 112 of the Municipal Powers Act (chapter C-47.1) located on lands in the domain of the State;
— the Boisé-de-Marly plant habitat described in section 7; or
— any of the following parks listed in Schedule D to the Charter of Ville de Montréal, metropolis of Québec (chapter C-11.4):
— Parc du Mont-Royal;
— Parc de l’Anse-à-l’Orme;
— Parc du Cap-Saint-Jacques;
— Parc du Bois-de-l’Île-Bizard;
— Parc du Bois-de-Liesse;
— Parc de l’Île-de-la-Visitation;
— Parc de la Pointe-aux-Prairies;
— Parc du Bois-de-Saraguay.
A person may also transplant wild leek plants (Allium tricoccum var. tricoccum and Allium tricoccum var. burdickii) under the following conditions:
(1)  the plants would otherwise be destroyed because of an activity that will be carried out on the harvest site, in accordance with the Environment Quality Act (chapter Q-2);
(2)  the transplantation is carried out between 15 April and 15 June;
(3)  the transplantation is carried out manually;
(4)  the transplantation site has features and conditions that are favourable to the survival of the plants to be transplanted;
(5)  where 500 or more plants are to be transplanted, the transplantation work is supervised by a person with qualifications in biology, ecology, forestry, horticulture or landscaping; and
(6)  an activity report is sent electronically to the Minister, using the forms or templates available on the website of the Minister’s department, in the 30 days following the transplantation.

5. The prohibitions referred to in section 16 of the Act respecting threatened or vulnerable species (chapter E-12.01) do not apply to the maidenhair fern, Canadian wild ginger, crinkleroot, large toothwort, Canada lily, ostrich fern, bloodroot, white trillium or large-flowered bellwort, except as regards the annual harvesting from a wild population of more than 5 whole specimens or underground parts of any of those species or the trading in any whole specimen or any underground part harvested from a wild population.
The prohibitions also do not apply if the specimens of a wild population of the species are situated in a habitat that is to be irremediably altered as a result of the carrying out of a project authorized under the Environment Quality Act (chapter Q-2).

DIVISION IV
PLANT HABITATS
6. For the purposes of this Division, the boundary of the littoral zone is the boundary of the littoral zone defined in the first paragraph of section 4 of the Regulation respecting activities in wetlands, bodies of water and sensitive areas (chapter Q-2, r. 0.1).

7. The following are plant habitats of threatened species and vulnerable species:
— Alvar-de-l’Île-de-Pierre (Laval);
The habitat corresponds to an island known and designated as “île de Pierre” on the Des Prairies river, in the territory of Ville de Laval. The habitat is demarcated on a chart prepared by the Minister;
— Alvar-de Quyon (Outaouais);
The habitat corresponds to lot 5 815 691, in the territory of Municipalité de Pontiac, Municipalité régionale de comté Les Collines-de-l’Outaouais. The habitat is demarcated on a chart prepared by the Minister;
— Anse-Ross (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, of a place known and designated as “anse Ross” on the shores of the St. Lawrence River, in the territory of Ville de Lévis (Saint-Nicolas). The habitat is demarcated on a chart prepared by the Minister;
— Baie-des-Anglais (Montérégie);
The habitat corresponds to a zone situated northwest of the Marcel-Raymond ecological reserve, on the shores of the Richelieu river, to the west of Rang Mélaven road, in the territory of Municipalité d’Henryville, Municipalité régionale de comté du Haut-Richelieu. The habitat is demarcated on a chart prepared by the Minister;
— Baie-du-Havre-aux-Basques (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a series of sites on Îles-de-la-Madeleine between the Du Havre Aubert and Du Cap aux Meules islands on the periphery of Du Havre aux Basques bay. The habitat is demarcated on a chart prepared by the Minister;
— Barachois-de-Bonaventure (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a series of islands that form part of the barachois in the Bonaventure river, in the territory of Ville de Bonaventure, Municipalité régionale de comté de Bonaventure. The habitat is demarcated on a chart prepared by the Minister;
— Barachois-de-Fatima (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a barachois immediately north of a place known and designated as “cap Vert” on Îles-de-la-Madeleine. The habitat is demarcated on a chart prepared by the Minister;
— Bassin-aux-Huîtres (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a site on De la Grande Entrée island on the periphery of Aux Huîtres basin on Îles-de-la-Madeleine. The habitat is demarcated on a chart prepared by the Minister;
— Battures-de-l’Île-aux-Oies (Chaudière-Appalaches);
The habitat corresponds to the marsh on the shores of the St. Lawrence River, in a place known and designated as “Battures de l’Îles aux Oies”, the western boundary of which is situated opposite lot 3 688 071 and the eastern boundary of which is situated opposite lot 3 474 982, in the territory of Municipalité de la paroisse de Saint-Antoine-de-l’Île-aux-Grues, Municipalité régionale de comté de Montmagny. The habitat is demarcated on a chart prepared by the Minister;
— Boisé-de-Marly (Capitale-Nationale);
The habitat corresponds to lots 1 406 540, 1 660 355 and 1 660 358 situated in the Marly wooded area, in the territory of Ville de Québec (Sainte-Foy). The habitat is demarcated on a chart prepared by the Minister;
— Chenal-Proulx (Montérégie);
The habitat corresponds to the bed and littoral, up to the boundary of the littoral zone, of the channel known and designated as “chenal Proulx” in the vicinity of Claude island and the Sainte-Anne rapids in De Vaudreuil bay, in the territory of Ville de L’Île-Perrot, Municipalité régionale de comté de Vaudreuil-Soulanges. The habitat is demarcated on a chart prepared by the Minister;
— Dune-du-Nord (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a site on Îles-de-la-Madeleine on the south-east side of Highway 199 between Aux Loups and La Grosse Île islands at a place known and designated as “dune du Nord”. The habitat is demarcated on a chart prepared by the Minister;
— Éboulis-de-Serpentine-du-Mont-Caribou (Chaudière-Appalaches);
The habitat corresponds to an escarpment and talus on the eastern flank of Mont Caribou, within the Serpentine-de-Coleraine ecological reserve, in the territory of Municipalité de Saint-Joseph-de-Coleraine, Municipalité régionale de comté des Appalaches. The habitat is demarcated on a chart prepared by the Minister;
— Érablière-de-la-Baie-Durand (Laurentides);
The habitat corresponds to a sugar maple forest in the territory of Municipalité de Notre-Dame-du-Laus, Municipalité régionale de comté d’Antoine-Labelle. The habitat is demarcated on a chart prepared by the Minister;
— Falaise-du-Mont-Saint-Alban (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to the eastern face of the limestone cliffs of Mont Saint-Alban in Forillon National Park, in the territory of Ville de Gaspé, Municipalité régionale de comté de La Côte-de-Gaspé;
— Fief-de-Vitré (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, on the shores of the St. Lawrence River, from L’anse de Vincennes heading west up to lot 3 020 323, in the territories of Ville de Lévis and Municipalité de Beaumont, Municipalité régionale de comté de Bellechasse. The habitat is demarcated on a chart prepared by the Minister;
— Grand-Bois-de-Saint-Grégoire (Montérégie);
The habitat corresponds to the wooded part of lots 4 160 249, 4 160 250 and 6 269 778, in the territory of Municipalité de Mont-Saint-Grégoire, Municipalité régionale de comté du Haut-Richelieu. The habitat is demarcated on a chart prepared by the Minister;
— Île-Beauregard (Montérégie);
The habitat corresponds to the southern tier of lot 5 216 554 situated on Beauregard island, in the Beauregard island nature reserve, forming part of the îles de Verchères archipelago, in the territory of Municipalité de Verchères, Municipalité régionale de comté de Marguerite-d’Youville. The habitat is demarcated on a chart prepared by the Minister;
— Île-Brisseau (Abitibi-Témiscamingue);
The habitat corresponds to a place known and designated as “île Brisseau” in Lac Témiscamingue, in the territory of Municipalité de Duhamel-Ouest, Municipalité régionale de comté de Témiscamingue. The habitat is demarcated on a chart prepared by the Minister;
— Île-Rock (Montréal);
The habitat corresponds to a rocky island, named “île Rock”, and its littoral, situated in the Lachine Rapids, between Des Soeurs and Aux Chèvres islands, in the territory of Ville de Montréal (LaSalle). The habitat is demarcated on a chart prepared by the Minister;
— Îles-Arthur-et-Bienville (Montérégie);
The habitat corresponds to Arthur and Bienville islands, which form part of the Micocoulier ecological reserve, in the territory of Ville de Coteau-du-Lac, Municipalité régionale de comté de Vaudreuil-Soulanges. The habitat is demarcated on a chart prepared by the Minister;
— Joannès (Abitibi-Témiscamingue);
The habitat corresponds to a group of springs situated approximately 2 km to the north of Joannès lake, on the north side of Highway 117, in the territory of Ville de Rouyn-Noranda. The habitat is demarcated on a chart prepared by the Minister;
— Lac-Berry (Abitibi-Témiscamingue);
The habitat corresponds to the periphery of a spring and its effluents, including a part of lot 4 880 291, situated northwest of Berry lake, in the territory of Municipalité de Berry, Municipalité régionale de comté d’Abitibi. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-l’Anse-du-Cap (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, of an area situated on either side of the mouth of the Vincelotte river on the St. Lawrence River, in the territory of Municipalité de Cap-Saint-Ignace, Municipalité régionale de comté de Montmagny. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-l’Anse-Verte (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, of a place known and designated as “anse Verte” on the shores of the St. Lawrence River, in the territory of Municipalité de Berthier-sur-Mer, Municipalité régionale de comté de Montmagny. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-la-Pointe-à-Bourdeau (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, of a habitat the greater part of which is situated to the west of a place known and designated as “pointe à Bourdeau”, in the territory of Municipalité du canton de Ristigouche-Partie-Sud-Est and Municipalité de Pointe-à-la-Croix, Municipalité régionale de comté d’Avignon. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-l’Île-Avelle (Montérégie);
The habitat corresponds to a part of the south-eastern littoral of Avelle island, forming part of the Îles-Avelle-Wight-et-Hiam ecological reserve, in the territory of Ville de Vaudreuil-Dorion, Municipalité régionale de comté de Vaudreuil-Soulanges. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-l’Île-des-Juifs (Laurentides);
The habitat corresponds to part of the littoral and flood zone in the southern part of Des Juifs island, in the territory of Ville de Rosemère, Municipalité régionale de comté de Thérèse-De-Blainville. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-Listuguj (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a part of the intertidal zone, up to the boundary of the littoral zone, of a habitat situated approximately 1 km east of a place known and designated as “pointe à Bourdeau”, in the territory of Municipalité de Pointe-à-la-Croix, Municipalité régionale de comté d’Avignon. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-Saint-Jean-Port-Joli (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone on the shores of the St. Lawrence River, up to the boundary of the littoral zone, up to Municipalité de Saint-Jean-Port-Joli, Municipalité régionale de comté de L’Islet, the western boundary of which is situated opposite lot 3 873 822 and the eastern boundary of which is situated opposite lot 6 369 963. The habitat is demarcated on a chart prepared by the Minister;
— Marais-de-Saint-Michel-de-Bellechasse (Chaudière-Appalaches);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, to the west of the pier of Municipalité de Saint-Michel-de-Bellechasse, on the shores of the St. Lawrence River, in the Municipalité régionale de comté de Bellechasse. The habitat is demarcated on a chart prepared by the Minister;
— Marais-Léon-Provancher (Capitale-Nationale);
The habitat corresponds to the intertidal zone, up to the boundary of the littoral zone, bounded on the shoreline by the Marais-Léon-Provancher nature reserve and to the east by the Battures-de-Saint-Augustin-de-Desmaures nature reserve, on the St. Lawrence River, in the territories of Ville de Neuville, Municipalité régionale de comté de Portneuf and Ville de Saint-Augustin-de-Desmaures. The habitat is demarcated on a chart prepared by the Minister;
— Marches-Naturelles (Capitale-Nationale);
The habitat corresponds to the bed and littoral of the Montmorency river, up to the boundary of the littoral zone, between the Des Marches-Naturelles dam and the bridge on Highway 360, in the territory of Municipalité de Boischatel, Municipalité régionale de comté de La Côte-de-Beaupré. The habitat is demarcated on a chart prepared by the Minister;
— Marécage-de-la-Grande-Île (Lanaudière);
The habitat corresponds to the south-west part of lot 4 506 263 in the Grande-Île wildlife sanctuary, in the Îles de Sorel archipelago, in the territory of Municipalité de Saint-Ignace-de-Loyola, Municipalité régionale de comté de D’Autray. The habitat is demarcated on a chart prepared by the Minister;
— Marécage-de-l’Île-Bouchard (Lanaudière);
The habitat corresponds to a wetland complex, including a part of lot 3 731 028 on Bouchard island, forming part of the Îles de Verchères archipelago, in the territory of Municipalité de la paroisse de Saint-Sulpice, Municipalité régionale de comté de L’Assomption. The habitat corresponds to the channel between À Chalut and Marie islands, as well as to a strip of marshes and swamps situated on either side including a part of lots 5 216 557, 5 216 558 and 5 216 559, forming part of the Îles de Verchères archipelago, in the territory of Municipalité de Verchères, Municipalité régionale de comté de Marguerite-d’Youville. The habitat corresponds to the ledges and crevices of the limestone cliffs of Montagne de Roche in Forillon National Park, in the territory of Ville de Gaspé, Municipalité régionale de comté de La Côte-de-Gaspé;
— Mont-Fortin (Bas-Saint-Laurent);
The habitat corresponds to the ledges, rock faces and colluvium on the steep slopes of the schist cliffs of Mont Fortin in the Fernald ecological reserve, in the unorganized territory of Municipalité régionale de comté de Matane;
— Mont-Logan (Bas-Saint-Laurent);
The habitat corresponds to the main ridge on Mont Logan and to the prairies, snow beds and stream banks of the subalpine and alpine belts of the Mont Logan Pease basin, as well as the ledges, rock faces and colluvium on the steep slopes of Mont Griscom in Parc national de la Gaspésie, in the unorganized territory of Municipalité régionale de comté de Matane;
— Mont-Matawees (Bas-Saint-Laurent);
The habitat corresponds to the ridges, ravines and ledges of the schist cliffs of Mont Matawees in the Fernald ecological reserve, in the unorganized territory of Municipalité régionale de comté de Matane;
— Ormes-Lièges-du-Canton-de-Chatham (Laurentides);
The habitat corresponds to part of lot 4 422 524 at its southwestern extremity, a part of lot 4 423 878 at its western extremity and part of lot 4 424 034 in the territory of Ville de Brownsburg-Chatham, Municipalité régionale de comté d’Argenteuil. The habitat is demarcated on a chart prepared by the Minister;
— Parc-de-la-Plage-Jacques-Cartier (Capitale-Nationale);
The habitat corresponds to a section of the rocky cliffs of the promontory of Québec, in the territory of Ville de Québec (Sainte-Foy), bounded to the north by land owned by the Canadian National Railway Company and to the south by a drop-off. The habitat is demarcated on a chart prepared by the Minister;
— Parc-du-Mont-Royal (Montréal);
The habitat corresponds to a part of lot 1 354 904, situated in the north-east sector of Parc du Mont-Royal, in the territory of Ville de Montréal. The habitat is demarcated on a chart prepared by the Minister;
— Platières-de-la-Grande-Rivière (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to the banks of the Grande-Rivière river in Gaspésie, up to the boundary of the littoral zone, in the territory of Ville de Grande-Rivière, Municipalité régionale de comté du Rocher-Percé;
— Premier-Lac-des-Îles (Bas-Saint-Laurent);
The habitat corresponds to the Premier Lac des Îles sector situated in Parc national de la Gaspésie, in the unorganized territory of Municipalité régionale de comté de Matane;
— Rives-Calcaires-du-Pont-Déry (Capitale-Nationale);
The habitat corresponds to the bed and littoral of the Jacques-Cartier river, up to the boundary of the littoral zone, between the Déry bridge and the first dam upstream from the bridge, in the territory of Ville de Pont-Rouge, Municipalité régionale de comté de Portneuf. The habitat is demarcated on a chart prepared by the Minister;
— Rivière-des-Mille-Îles (Laval and Lanaudière);
The habitat corresponds to 2 parts of the bed and littoral of the Des Mille-Îles river, up to the boundary of the littoral zone. The first part occupies 200 m of the banks between Aux Vaches and Saint-Pierre islands. The second part, delimited to the west by Saint-Jean island, extends over a dozen kilometres, in the territory of the cities of Laval and Terrebonne, in the regional county municipalities of Laval and Des Moulins. The habitat is demarcated on a chart prepared by the Minister;
— Rivière-Godefroy (Centre-du-Québec);
The habitat corresponds to a strip of land 250 m wide in the southern part of the Léon-Provancher ecological reserve and to the northern and southern littoral of the Godefroy river, up to the boundary of the littoral zone, between the Autoroute 30 bridge and Saint-Paul lake, in the territory of Ville de Bécancour, Municipalité régionale de comté de Bécancour. The habitat is demarcated on a chart prepared by the Minister;
— Ruisseau-des-Pères (Mauricie);
The habitat corresponds to an intertidal zone, up to the boundary of the littoral zone, to the east of the mouth of the Batiscan river, in the territory of Municipalité de Batiscan, Municipalité régionale de comté Les Chenaux. The habitat is demarcated on a chart prepared by the Minister;
— Serpentine-du-Mont-Albert (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to the tundra vegetation growing on the serpentine plateau of Mont Albert, to the rocky serpentine slopes of the Du Diable ravine and to the east and south flanks of the mountain from an elevation of 550 m upward, in Parc National de la Gaspésie, in the unorganized territory of Municipalité régionale de comté de La Haute-Gaspésie;
— Des Sillons (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a series of sites on Îles-de-la-Madeleine on either side of Highway 199 on Du Havre aux Maisons island, in particular along the places known and designated as “les Sillons” and “la dune du Sud”. The habitat is demarcated on a chart prepared by the Minister;

— Tourbière-de-Mont-Albert (Gaspésie–Îles-de-la-Madeleine);
The habitat corresponds to a part of the open black spruce-tamarack-ericaceous forest along Highway 198, in the unorganized territory of Municipalité régionale de comté de La Haute-Gaspésie. The habitat is demarcated on a chart prepared by the Minister;
— Tourbière-de-Saint-Valérien (Bas-Saint-Laurent);

SPECIAL PROVISIONS
8. The prohibitions referred to in section 16 of the Act respecting threatened or vulnerable species (chapter E-12.01) do not apply to servicing activities of Hydro-Québec’s power line network or of road infrastructures by the Minister responsible for the administration of the Act respecting roads (chapter V-9).
In addition, the prohibitions referred to in section 17 of the Act respecting threatened or vulnerable species do not apply to servicing activities of Hydro-Québec’s power line network carried out in a plant habitat to the extent that they are carried on without jeopardizing the viability of the threatened or vulnerable species present therein and the components of the surroundings that ensure their survival.
For the purposes of this section, servicing activities include inspections, reconstruction, repairs and control of vegetation, and are carried out on the infrastructure concerned or in its right of way, as well as the cutting of trees or shrubs that could accidentally come in contact with electrical wires, without further impact on the natural environment.
Access to infrastructures concerned by servicing carried on in accordance with this section must be by existing roads, where they exist.

9. The prohibitions from mutilating or destroying any specimen of a threatened or vulnerable species set out in section 16 of the Act respecting threatened or vulnerable species (chapter E-12.01) and the prohibitions set out in section 17 of the Act do not apply to activities carried out in an emergency situation on Hydro-Québec’s power line network.

MONETARY ADMINISTRATIVE PENALTIES

9.1. A monetary administrative penalty of $500 in the case of a natural person and $2,500 in any other case may be imposed on anyone who violates a condition provided for in any of subparagraphs 1, 5 or 6 of the second paragraph of section 4 for the transplantation of wild leek plants.

9.2. A monetary administrative penalty of $750 in the case of a natural person and $3,500 in any other case may be imposed on anyone who
(1)  violates a condition provided for in any of subparagraphs 2, 3 or 4 of the second paragraph of section 4 for the transplantation of wild leek plants;
(2)  does not use an existing road, where one exists, to access infrastructures concerned by servicing carried on in accordance with the first or second paragraph of section 8, in contravention of the fourth paragraph of this section.
