Regulation respecting the scale of fees and duties related to the development of wildlife
Act respecting the conservation and development of wildlife
(chapter C-61.1, ss. 54, 97 and 163).
The fees prescribed in the Regulation have been indexed as of 1 April 2022 pursuant to the notice published in Part 1 (French) of the Gazette officielle du Québec of 11 December 2021, page 712. CERTIFICATES
1. (Revoked).

1.1. The fees payable for the issue of a hunter’s or trapper’s certificate for a person who fulfils the conditions set out in the first paragraph of section 3.1 of the Regulation respecting hunting (chapter C-61.1, r. 12) are $2.27.
The fees payable for the issue of a hunter’s certificate for the handling of a firearm for a person who fulfils the conditions set out in the third paragraph of section 3.1 of the Regulation respecting hunting are $16.34.

2. The fee payable for the replacement of a hunter’s or trapper’s certificate that has been lost, stolen, made unusable or already issued but not renewed is $16.78.

4. The following fees are payable on the issue of a trapping licence:
(1)  resident professional trapping licence: $27.02; and
(2)  non-resident professional trapping licence: $366.95.

4.2. The fees payable on the issue of an aquaculture licence are fixed as follows:
(1)  (paragraph revoked);
(2)  licence for operating a breeding pond: $16.10;
(3)  licence for operating a fish-tank for baitfish: $43.17;
(4)  licence to extract roe and milt and to transport: $70.60.
The fees payable for renewal of an aquaculture licence, other than a non-renewable licence to extract roe and milt and to transport, are those prescribed in the first paragraph.

The fees payable for an application for the renewal or replacement of a licence correspond to the amount provided for in the first paragraph.
If an application for the renewal of a licence is submitted or if the fees are received between 1 March and 31 March, the fees payable for the application are equal to twice the amount provided for in the first paragraph.

§ 3.  — Outfitting
5. For the purposes of this Subdivision, a partnership is considered to be a resident of Québec if the majority of the partners are residents of Québec.
A corporation is considered to be a resident of Québec if the majority of its voting shares are held by residents of Québec and the majority of its shareholders are residents of Québec or if the majority of its members are residents of Québec.

5.1. The fees payable for examination of an application for the issue of an outfitter’s licence are $3,700.05.

6. The fees payable on the issue of an outfitter’s licence are fixed as follows for:
(1)  resident outfitter’s licence: $320.17;

6.0.1. The fees payable for examination of an application to transfer an outfitter’s licence are $379.33.

6.1. The fees payable for renewal of an outfitter’s licence are those prescribed in section 6 and the fee payable for the transfer of such licence is $40.13.

§ 4.  — Fur trade
7. The fees payable on the issue of a licence for the activities governed by section 53 of the Act are as follows:
(1)  trader’s or intermediary’s licence to sell or trade undressed pelts:
(a)  resident: $495.69;
(b)  non-resident: $1,007.15;
(2)  licence to dress raw pelts for taxidermy purposes: $43.53;
(3)  licence to dress raw pelts: $379.49;
(4)  public auction licence to sell raw pelts: $1,254.61.

§ 4.1.  — Wildlife management purposes

7.0.1. The fees payable for examination of an application for the issue of a licence for wildlife management purposes are fixed as follows:
i.  for all activities performed in a single administrative region or in 2 bordering administrative regions: $350.83;
ii.  for all activities performed in more than 2 bordering administrative regions or in 2 non-bordering administrative regions or more: $686.30.
Despite the foregoing, no fee is payable for examination of an application for the issue of a licence for wildlife management purposes for activities performed by a regional county municipality pursuant to section 105 or 106 of the Municipal Powers Act (chapter C-47.1).

7.0.2. The fees payable for examination of an application to amend an application made under section 7.0.1 of this Regulation or to amend a previously issued licence for wildlife management purposes are fixed as follows:

§ 5.  — Replacement of a licence

7.1. The cost for replacing a hunting, fishing or trapping licence that has been lost, stolen or rendered unusable is $5.61.

DIVISION III
RIGHT OF ACCESS
§ 1.  — Hunting
8. The right of access fees for restricted hunting in wildlife sanctuaries are prescribed in Schedule II.

9. The right of access fees for unrestricted hunting in wildlife sanctuaries are prescribed in Schedule III.
Where no lodging in a camp is provided, the amount indicated in the third column of Schedule III in respect of the right of access fee for hunting small game within the meaning of section 2 of the Regulation respecting hunting activities (chapter C-61.1, r. 1) shall include the right of access fee for a child under the age of 18 accompanied by a parental guardian.

§ 2.  — Trapping

§ 2.1.  — Fishing

10.1. In the wildlife sanctuaries mentioned in Column I of Schedule IV, the right of access fee for fishing any species other than Atlantic salmon is fixed in Column II of that Schedule.
Notwithstanding the foregoing, where lodging in a camp is provided, the right to access fee for a period of 7 consecutive days, the amount of which is indicated in Column II of Schedule IV, is not applicable.
Where no lodging in a camp is provided, the amount indicated in Column II of Schedule IV shall include the right of access fee for a child under the age of 18 who is accompanied by a parental guardian.
The right of access fee referred to in the third paragraph shall also apply to children under the age of 18 who are part of a group that is supervised by a person 18 years of age or older who has the right of access.

10.2. In the wildlife sanctuaries mentioned in Column I of Schedule V, the right of access fee for a wildlife sanctuary or based on the sectors of a wildlife sanctuary, as the case may be, for fishing Atlantic salmom or any other species during salmon fishing season is fixed.

DIVISION III.1
WILDLIFE HABITAT MODIFICATION
M.O. 2017-001, s. 4.
10.3. In this Division,
(1)  wildlife habitat means a wildlife habitat within the meaning of section 1 of the Regulation respecting wildlife habitats (chapter C-61.1, r. 18);
(2)  habitat of a threatened or vulnerable species means a habitat of a threatened or vulnerable species designated in the Regulation respecting threatened or vulnerable wildlife species and their habitats (chapter E-12.01, r. 2);
(3)  fish habitat means a fish habitat within the meaning of paragraph 7 of section 1 of the Regulation respecting wildlife habitats (chapter C-61.1, r. 18);
(4)  wildlife management work means work to restore, improve, preserve or develop wildlife habitat.

10.4. The fees payable for examination of an application for authorization to perform an activity that modifies a wildlife habitat are fixed as follows:
(1)  for all activities in a habitat of a threatened or vulnerable species to the exclusion of wildlife management work: $2,715.56;
(2)  for all construction work for a hydroelectric generating station or a dam in a fish habitat: $2,772.57;
(3)  for all activities in a wildlife habitat that are not described in paragraphs 1 and 2 of this section to the exclusion of wildlife management work and work carried out by a regional county municipality in accordance with section 105 or 106 of the Municipal Powers Act (chapter C-47.1):
i.  for a natural person: $693.97;
ii.  for a legal person: $2,082.99.

10.5. The fees payable for examination of an application to amend an application made under section 10.4 of this Regulation or to amend a previously issued authorization to perform an activity that modifies a wildlife habitat are fixed as follows:
(1)  for an application or an authorization referred to in paragraph 1: $678.62;
(2)  for an application or an authorization referred to in paragraph 2: $692.87;
(3)  for an application or an authorization referred to in paragraph 3:
subparagraph i: $173.22;

DIVISION IV
LEASE OF EXCLUSIVE RIGHTS

11. The annual rent for a lease of exclusive rights is fixed as follows for each of the exclusive rights in the lease:
(1)  (subparagraph revoked);
(2)  (subparagraph revoked);
(3)  Lease of exclusive fishing rights, for outfitting purposes:
(a)  fishing in a salmon river or in a part thereof referred to in the Québec Fishery Regulations (1990) (SOR/90-214); the amount is calculated by applying the following formula:
Kt ×(L × A)× C + Ke × (S × P);

(b)  fishing in a territory other than the territory referred to in clause a: $22.04/km2
(4)  Lease of exclusive fishing rights, for purposes other than those of outfitting: $71.50/year.
For the purposes of calculating the rent fixed in clause a of subparagraph 3 of the first paragraph, the first part of the formula expresses the intrinsic value of the territory where:
(Kt): the territorial constant, equivalent to $60.13;
(L): the length of the river under lease, in kilometres;
(A): the accessibility of the territory on a scale from 1 to 6 (1 for rivers not accessible by road, up to 6 for rivers along asphalted roads);
(C): the residence of the holder of an outfitter’s licence;

i. for the holder of a resident outfitting licence: 1
ii. for the holder of a non-resident outfitting licence: 5
The second part of the formula expresses the quantitative and qualitative value of the resource, where:
(Ke): the resource development constant, equivalent to $16.03;
(S): the annual average number of salmon taken, calculated over a 10-year period ending in the year preceding the billing of the rent. Years in which no salmon were taken do not figure in the calculation of the average;
(P): the average annual weight of salmon calculated over a 10-year period ending in the year preceding the billing of the rent, where an average weight of 2 kilos or less is given a rating of 1, and where each 0.5 kilo exceeding 2 kilos increases the rating by 0.1. Years in which no salmon were taken do not figure in the calculation of the average.

12. Notwithstanding subparagraph 3 of the first paragraph of section 11 the minimum annual rent for a lease of exclusive rights is calculated as follows for each exclusive right in the lease:

15. Any fee or cost, any annual rent or minimum amount of annual rent, any contribution toward the funding of the Fondation de la faune du Québec, payable under this Regulation, and constants Kt and Ke, referred to in the second paragraph of section 11, are adjusted annually, on 1 April of each year, by applying to their value for the preceding year the annual percentage change, computed for the month of June of the preceding year, in the general Consumer Price Index (CPI), published by Statistics Canada.
The Minister is to publish the results of the adjustment in Part 1 (French) of the Gazette officielle du Québec or by any other appropriate means.
