Protective Helmets Regulation

1. The references to the standards set out in this Regulation shall, unless otherwise indicated, be read as including any amendments made thereto.

2. Every person riding on a motorcycle, or moped, in a sidecar, on an off-road vehicle covered by the Act respecting off-highway vehicles (chapter V-1.2) or in a sleigh or trailer being towed by such a vehicle shall wear a protective helmet that complies with one of the following recognized standards of manufacture, sale, installation and use:
(1)  Standard CAN-3-D230 of the Canadian Standards Association;
(2)  Standard DOT FMVSS 218 of the United States Department of Transportation;
(3)  the standard entitled “Specifications for Protective Headgear for Vehicular Users Z90.1” of the American National Standards Institute;
(4)  the Snell Memorial Foundation standard;
(5)  the British Standards Institute standard;
(6)  ECE Regulation 22, United Nations Economic Commission for Europe standard.
A protective helmet must bear, at all times, the label affixed by the manufacturer in compliance with the requirements of the standard of manufacture.

2.1. Every person riding a power-assisted bicycle on a public highway must wear a protective helmet that complies with the following standards of manufacture:
(1)  be made of a rigid shell with a padded interior; and
(2)  be equipped with a chin strap.

3. Moreover, to be in compliance, a protective helmet shall meet the following standards of use:
(1)  (paragraph revoked);
(2)  it shall be correctly adjusted and firmly attached by a chin strap; and
(3)  it shall be free of any modification to or deterioration of the internal or external structure. The helmet may, however, be repainted.

4. This Regulation replaces:
(1)  the Regulation respecting protective helmets for motorcyclists and snowmobilists (R.R.Q., 1981, c. C-24, r. 7); and
(2)  the Regulation respecting protective helmets used by persons riding on light motorcycles or mopeds or in sidecars (O.C. 1333-82, 82-06-02).
