An accredited manufacturer or wholesaler or an intermediary may pay or reimburse to a person covered by the basic prescription drug insurance plan all or part of the price of the following medications:
(
1
)
those entered on the list drawn up by the Minister under section 60 of the Act respecting prescription drug insurance (
chapter A-29.01
) for which the lowest price method does not apply;
(
2
)
those for which a generic or biosimilar version is not entered on the list drawn up by the Minister under section 60 of the Act.

Where a medication that was referred to in section 1 ceases to be referred to in that section, an accredited manufacturer or wholesaler or an intermediary may continue to pay or reimburse to a person covered by the basic prescription drug insurance plan all or part of the price of the medication for a maximum period of 30 days following the beginning of the application of the lowest price method to the medication or the entry of a generic or biosimilar version on the list drawn up by the Minister under section 60 of the Act, as the case may be.

An accredited manufacturer or wholesaler or an intermediary may continue to pay or reimburse to a person covered by the basic prescription drug insurance plan all or part of the price of a medication that is not referred to in section 1 if, before the coming into force of paragraph 1 of section 80.2 of the Act, that person has already received such a payment or reimbursement for that medication.
