3. If the municipal corporation of any city or town fail to keep in repair any such road, street or highway within the limits thereof, such corporation shall be liable to a fine of $50 to $2 000 before which the conviction is had; and such corporation shall be also civilly responsible for all damages sustained by any person by reason of such default, provided the action for the recovery of such damages be brought within six months after the same have been sustained.

3.
