399. Any infringement of the provisions of this division, other than a corrupt practice contemplated in section 398, shall be an offence punishable by a fine of one hundred to five hundred dollars and imprisonment not exceeding six months.
Every person is guilty of an offence under this section who permits, tolerates or participates in any way in the commission thereof.
