353. (1)  If a returning-officer wilfully delays, neglects or refuses to return any person as elected to serve in the Assemblée nationale for any electoral district, and the court hearing an election petition respecting the election for such electoral district decides that such person should have been returned, such person may sue the returning-officer in the Superior Court for the judicial district in which such electoral district is wholly or partly situated and recover from him a sum of five hundred dollars, together with the costs of suit and all damages he has sustained by reason of such delay, neglect or refusal on the part of the returning-officer.
(2)  Nevertheless, such action must be commenced within one year after the commission of the act on which it is founded or within six months after the date of the final decision upon the petition relating to such election.
