Section 119 Disposition versions

119. The Tribunal deducts from the amount of the final indemnity granted

(1)  the market value of the right belonging to the expropriating party that was transferred to the expropriated party;

(2)  the amounts paid by the expropriating party under section 110 as a displacement indemnity if the expropriating party was obliged to have the displacement work carried out itself as well as, if applicable, the expenses and the damages in reparation for any injury caused to the person who had to make the displacement themself; and

(3)  the expenses incurred by the expropriating party to evict the divested party following a judgment rendered under section 44.
