1098. Every municipal corporation may, for the purpose of supplying itself with the materials necessary for the building, maintaining and repairing of the roads under its control, expropriate, by complying with this Title:
(1)  land containing sand, gravel or stone;
(2)  temporary servitudes of right of way over land lying between the public road and the places where it is desired to take out the sand, stone and gravel.
