Regulation respecting teaching licences
Education Act
(chapter I-13.3, s. 456).
On 10 August 2020, the Superior Court ordered a stay of the application of the Act to amend mainly the Education Act with regard to school organization and governance (S.Q. 2020, c. 1) to English language school boards until a judgment is rendered on the merits of the application for judicical review challenging the validity of certain provisions of the Act.

CHAPTER 1
PURPOSE

1. The purpose of this Regulation is to establish the classes of teaching licences the Minister may determine pursuant to section 23 of the Education Act (chapter I-13.3), the activities those classes allow and, as applicable, their period of validity and attendant restrictions.
A further purpose is to determine the diplomas or other training conditions that lead to teaching licences, as well as the procedure for obtaining or renewing a teaching licence.

CHAPTER 2
CLASSIFICATION OF TEACHING LICENCES

2. The Minister may issue teaching licences for general education and for vocational training. The teaching licences are valid for the whole territory of Québec or are restricted to specific school service centres.
General education includes preschool education services, elementary and secondary school instructional services, and adult education services.

3. The teaching licences valid for the whole territory of Québec are the general education teaching diploma and the vocational training teaching diploma.
The diplomas are permanent, subject to the powers the Minister may exercise under the Education Act (chapter I-13.3).

4. The teaching licence valid for specific school boards only is the general education teaching diploma for the Cree and Kativik school boards.

5. The Minister may also issue probationary teaching permits to applicants for whom supplementary training requirements are imposed pursuant to this Regulation in order to obtain a teaching diploma, and issue provisional teaching licences to persons enrolled in a program leading to a teaching diploma.
The probationary permits and provisional teaching licences authorize the same teaching activities as the teaching diploma they lead to. They are valid for the time determined in this Regulation, subject to the powers the Minister may exercise under the Education Act (chapter I-13.3).

CHAPTER 3
DIPLOMAS AND OTHER TRAINING CONDITIONS REQUIRED TO OBTAIN A TEACHING DIPLOMA

6. The following persons may be issued a general education teaching diploma:
(1)  the holder of a diploma listed in Schedule I;
(2)  the holder of a teaching licence equivalent to a general education teaching diploma, without conditions, issued in another Canadian province or territory; and
(3)  the holder of a probationary general education teaching permit who has satisfied the supplementary training requirements as provided in subdivision 2 of Division 1 of Chapter 4.

7. The following persons may be issued a vocational training teaching diploma:
(1)  the holder of a diploma listed in Schedule II if the holder
(a)  has obtained a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III; and
(b)  has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught;
(2)  the holder of a vocational training teaching licence, without conditions, issued in another Canadian province or territory; and
(3)  the holder of a probationary vocational training teaching permit who has satisfied the supplementary training requirements as provided in subdivision 2 of Division 2 of Chapter 4.

8. The following persons may be issued a general education teaching diploma for Cree and Kativik school boards:
(0.1)  the holder of a 60-credit Certificate in Education for First Nations and Inuit from McGill University;
(1)  the holder of a teaching licence equivalent to a general education teaching diploma in a Native community, without conditions, issued in another Canadian province or territory; and
(2)  the holder of a probationary general education teaching permit for Cree and Kativik school boards who has satisfied the supplementary training requirements as provided in subdivision 2 of Division 3 of Chapter 4.

CHAPTER 4
PROBATIONARY PERMITS AND SUPPLEMENTARY CONDITIONS REQUIRED TO OBTAIN A TEACHING DIPLOMA

TEACHING IN GENERAL EDUCATION

§ 1.  — Conditions for issuance of a probationary general education teaching permit

10. The following persons may be issued a probationary general education teaching permit:
(1)  the holder of a diploma listed in Schedule IV;
(2)  the holder of a teaching licence equivalent to a general education teaching diploma, issued in another Canadian province or territory, subject to training conditions; and
(3)  the holder of a teaching licence equivalent to a general education teaching diploma, issued outside Canada on the basis of training equivalent to training leading to a diploma listed in Schedule I or IV.

§ 2.  — Conditions for issuance of a teaching diploma to holders of a probationary general education teaching permit

11. A person referred to in paragraph 1 of section 10 may be issued a general education teaching diploma after successfully serving the probationary period in accordance with subdivision 2 of Division 4 of Chapter 4.

12. A person referred to in paragraph 2 of section 10 may be issued a general education teaching diploma after satisfying the conditions set by the Minister equivalent to the conditions imposed on the person in the other Canadian province or territory and that have not yet been met.

13. A person referred to in paragraph 3 of section 10 may be issued a general education teaching diploma after successfully serving the probationary period in accordance with subdivision 2 of Division 4 of Chapter 4 and completing the following training:
(1)  six credits in teaching as part of a teacher training program in general education listed in Schedule I directly related to the program underlying the permit or an equivalent course given by Télé-université du Québec; and
(2)  three credits on the Québec school system, three credits in evaluation of learning and three credits in intervention with handicapped students or students with social maladjustments as part of a university teacher training program in general education listed in Schedule I or an equivalent course given by Télé-université du Québec.

§ 3.  — Validity and conditions for renewal of a probationary general education teaching permit

14. A probationary general education teaching permit is valid for 5 years and may be renewed for subsequent 5-year periods.
For a person referred to in section 12 or 13, the probationary permit is renewable only if the applicant has successfully met all the imposed requirements, except for the probationary period.
Despite the first paragraph, a renewal of a probationary permit following a failed probationary period is valid for one year only.

DIVISION 2
TEACHING IN VOCATIONAL TRAINING

§ 1.  — Conditions for issuance of a probationary vocational training teaching permit

15. The following persons may be issued a probationary vocational training teaching permit:
(0.1)  the holder of a diploma listed in Schedule V;
(1)  the holder of a vocational training teaching licence, issued in another Canadian province or territory, subject to training conditions; and
(2)  the holder of a vocational training teaching licence, issued outside Canada, if the holder
(a)  has training equivalent to training leading to a diploma listed in Schedule II or has successfully completed university training comprising 30 credits equivalent to a teacher training program in vocational training listed in Schedule V;
(b)  has obtained a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III; and
(c)  has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught.

15.1. A person referred to in paragraph 0.1 of section 15 may be issued a vocational training teaching diploma after successfully serving the probationary period in accordance with subdivision 2 of Division 4 of Chapter 4.

§ 2.  — Conditions for issuance of a teaching diploma to holders of a probationary vocational training teaching permit

16. A person referred to in paragraph 1 of section 15 may be issued a vocational training teaching diploma after satisfying the conditions set by the Minister equivalent to the conditions imposed on the person in the other Canadian province or territory and that have not yet been met.

17. A person referred to in paragraph 2 of section 15 may be issued a vocational training teaching diploma after successfully serving the probationary period in accordance with subdivision 2 of Division 4 of Chapter 4 and completing a course on the Québec school system offered as part of a university teacher training program in vocational training listed in Schedule II or an equivalent course given by Télé-université du Québec.

§ 3.  — Validity and conditions for renewal of a probationary vocational training teaching permit

18. A probationary vocational training teaching permit is valid for 5 years and may be renewed for subsequent 5-year periods.
However, a probationary permit is renewable only
(1)  for holders of a probationary permit issued pursuant to paragraph 1 of section 15, if the applicant has successfully met all the requirements imposed, except for the probationary period, if applicable;
(2)  for holders of a probationary permit issued pursuant to paragraph 2 of section 15, if the applicant has passed the course on the Québec school system offered as part of a university teacher training program in vocational training listed in Schedule II or an equivalent course given by Télé-université du Québec.
Despite the first paragraph, a renewal of a probationary permit following a failed probationary period is valid for one year only.

DIVISION 3
TEACHING IN GENERAL EDUCATION IN CREE AND KATIVIK SCHOOL BOARDS

§ 1.  — Conditions for issuance of a probationary general education teaching permit for Cree and Kativik school boards

19. The following persons may be issued a probationary general education teaching permit for Cree and Kativik school boards:
(1)  the holder of a diploma listed in Schedule VI, except the diploma referred to in paragraph 0.1 of section 8, and
(2)  the holder of a teaching licence for an equivalent level, issued in another Canadian province or territory, subject to training conditions, on the basis of a diploma equivalent to those listed in Schedule VI.

§ 2.  — Conditions for issuance of a teaching diploma to holders of a probationary general education teaching permit for Cree and Kativik school boards

20. A person referred to in paragraph 1 of section 19 may be issued a general education teaching diploma for Cree and Kativik school boards after successfully serving the probationary period in accordance with subdivision 2 of Division 4 of Chapter 4.

21. A person referred to in paragraph 2 of section 19 may be issued a general education teaching diploma for Cree and Kativik school boards after satisfying the conditions set by the Minister equivalent to the conditions imposed on the person in the other Canadian province or territory and that have not yet been met.

§ 3.  — Validity and conditions for renewal of a probationary general education teaching permit for Cree and Kativik school boards

22. A probationary general education teaching permit for Cree and Kativik school boards is valid for 5 years and may be renewed for subsequent 5-year periods.
For persons referred to in paragraph 2 of section 19, the probationary permit is renewable only if the applicant has successfully met all the imposed requirements, except for the probationary period, if applicable.
Despite the first paragraph, a renewal of a probationary permit following a failed probationary period is valid for one year only.

DIVISION 4
COMMON RULES FOR CERTAIN APPLICANTS FOR A TEACHING LICENCE

§ 1.  — Equivalence recognition

23. The Minister may recognize a diploma held by an applicant as equivalent to a diploma required under this Regulation.

24. In determining a diploma equivalence, the Minister may consider the number of years of schooling necessary to obtain the diploma and the number, nature and content of the courses taken and practicums served to obtain it.

25. If the Minister cannot recognize a full equivalence of a diploma the Minister considers to be substantially equivalent, the Minister may,
(1)  on the basis of the documents on file establishing the applicant’s professional experience or any other relevant fact, determine that the applicant has the competencies identified as missing; or
(2)  request the applicant substantiate, within the time the Minister specifies, the competencies identified as missing in a written document that must contain any relevant supporting documents pertaining to the applicant’s professional experience or that establish how the courses taken made it possible for the knowledge and qualifications to be acquired, or in other evaluation tools the Minister recognizes.

26. The Minister may refuse to recognize a diploma or competency equivalence or, in the likelihood that refresher training would enable the competencies identified as missing to be acquired, partially recognize the competencies. In the latter case, the Minister must set the training conditions to be satisfied by the applicant to have a full competency equivalence recognized.
Before refusing an equivalence or recognizing a partial equivalence, the Minister must allow the applicant to make written observations within the time the Minister specifies.
The second paragraph does not apply if the Minister has made a request pursuant to paragraph 2 of section 25.

§ 2.  — Probationary period

27. The purpose of the probationary period is to verify the competence and professional qualifications of the person on whom it is imposed under any of Divisions 1 to 3 of Chapter 4.
The probationary period focuses primarily on
(1)  the ability to communicate orally and in writing in an efficient manner, and to develop, adapt, manage and evaluate teaching-learning situations designed to enable students to develop the competency described in the programs of studies approved by the Minister, making use of information and communications technologies;
(2)  the ability to establish a rapport with the students individually or as a group, to maintain an atmosphere and environment conducive to the development of competency and to consider individual differences of all types;
(3)  the ability to establish interpersonal relations with parents, the other members of the staff of the educational institution and the partners responsible for the implementation of the services; and
(4)  the ability to act ethically and responsibly in performing the various duties and to be committed to a personal or collective process of professional development.

28. The probationary period consists of 900 hours of teaching.
It may, however, consist of fewer than 900 but not fewer than 600 hours if the objective described in section 27 has been achieved.
To calculate valid hours of teaching for the purposes of the probationary period, only hours taught in the period during which the probationary permit is valid are considered, under contracts of at least 200 teaching hours over 12 consecutive months and in accordance with sections 29 and 30.

29. The probationary period must be served with only one employer that is
(1)  a school service centre or a school board constituted under an Act;
(2)  a private educational institution to which the Act respecting private education (chapter E-9.1) applies; or
(3)  an educational institution that has entered into an agreement with the Minister enabling teaching to be recognized for the purposes of the probationary period.
A probationary period served in a school service centre or a school board may be served in 2 or more of the service centre’s or school board’s institutions.

30. The probationary period begins on the signing of a teaching contract consisting of at least 200 hours taught over 12 consecutive months.
As soon as the initial contract begins, the teacher trainee and a person assigned by the employer to supervise the probationary period must agree on the specific terms of the probationary period that are to guide supervision of the teaching and evaluation of the competence and professional qualifications to be verified by the probationary period.
Instruction provided in a situation described in the second paragraph of section 23 of the Education Act (chapter I-13.3) is not considered for the purposes of calculating the number of hours of teaching in the probationary period required by section 28. The teacher trainee may as well offer services to another employer while not bound by a contract in order to complete the required number of hours of teaching. Such a contract must, however, be entered into for fewer than 200 hours. An applicant may also enter into such contracts before beginning the required probationary period.

31. The probationary period supervisor is to monitor the teacher trainee and evaluate the trainee’s competence and qualifications using the evaluation criteria provided by the Minister.
If the probationary period is served in 2 or more of a school service centre’s or school board’s institutions, the principals who are not supervisors for the probationary period are to participate in the monitoring and evaluation of the teacher trainee in the manner indicated by the probationary period supervisor.

32. The probationary period supervisor is to provide the teacher trainee with a first progress report after 200 teaching hours and another similar report at the end of every employment contract.
Despite the foregoing, if the initial employment contract is for not more than 300 hours, the probationary period supervisor may decide to provide a progress report only at the end of the employment contract.
Every progress report must state the number of teaching hours it covers.
If a progress report indicates significant shortcomings, the probationary period supervisor is to make recommendations and set the appropriate measures in place to enable the teacher trainee to correct the shortcomings.

33. The probationary period supervisor is to furnish a final evaluation report at the end of the 900 hours in the probationary period.
The report may, however, be furnished as soon as the teacher trainee has taught for 600 hours if the probationary period supervisor is of the opinion that the teacher trainee has sufficiently mastered the competence and professional qualifications the probationary period seeks to verify.

34. The probationary period supervisor is to provide the final report to the employer who, after examining the report, concludes whether or not the probationary period objective has been attained. The employer then provides the report to the teacher trainee along with a certificate of achievement or a notice of failure, as applicable. The employer must send a copy of the report and, as applicable, the certificate or notice to the Minister.
A final report containing a notice of failure must specify the shortcomings observed and the reasons in support of the findings. It must also contain the appropriate recommendations to enable the teacher trainee to correct the shortcomings.

35. A person who fails a probationary period may serve a second probationary period if the person notifies the Minister in writing of the intention to do so within 60 days following receipt of the notice of failure. No further probationary period is possible if the person fails the second probationary period.
This subdivision applies to the second probationary period, with the necessary modifications, except that the duration of the second probationary period is 600 hours with no possible reduction of hours.

36. Notwithstanding any provision to the contrary, the probationary permit of a person who does not send the notice referred to in section 35 within the required time ceases to have effect on the expiry of the 60-day period set out in that section.
The same applies on failure of the second probationary period.
The Minister must notify the person who held the probationary permit of the permit expiry date as well as every school service centre, school board or institution in which the person was a teacher trainee.

§ 3.  — Language examination

37. Every applicant for a teaching diploma or probationary permit must have passed the written French or English examination recognized by the Minister for the purpose.
The same applies to an applicant for a provisional teaching licence issued pursuant to paragraph 1 of section 43.

38. If the greater part of an applicant’s training was acquired in a language other than French or English, the applicant must also pass an examination assessing French or English comprehension and oral language proficiency.

39. This subdivision does not apply to an applicant to whom a teaching diploma or probationary permit is issued on the basis of a teaching licence issued in another province or a Canadian territory, or to an applicant to whom a teaching diploma or probationary permit is issued for the Cree and Kativik school boards only.
This section does not operate to exempt an applicant from passing a language examination if the teaching licence issued to the applicant in another province or a Canadian territory is subject to such a condition.

CHAPTER 5
PROVISIONAL TEACHING LICENCES

DIVISION 1
TEACHING IN GENERAL EDUCATION

40. A provisional general education teaching licence may be issued to a person who
(1)  is in either of the following situations:
(a)  is enrolled in a teacher training program in general education recognized since September 2001 and listed in Schedule I and who proves
i.  that a bachelor’s degree or equivalent diploma has been obtained, excluding a university teacher training program in general education listed in Schedule I or IV;
ii.  that at least 45 university-level credits have been earned in mathematics, French studies, English studies, Hispanic studies, ethics and religious culture, physical education, drama, visual arts, music, dance, science and technology in the fields of physics, chemistry and biology, or in social sciences in the fields of geography and history and citizenship education; and
iii.  that at least 9 credits in education have been earned in the teacher training program in general education in which the person is enrolled, related to the person’s field of training, including at least 3 credits in 3 of the 5 following categories: educational psychology, the teaching of a subject in the Basic school regulation for preschool, elementary and secondary education, class management, training on the Québec school system, or intervention with handicapped students or students with social maladjustments or learning disabilities;
(b)  is enrolled in a teacher training program in general education, concentration in special education, recognized since September 2001 and listed in Schedule I and who proves
i.  that a bachelor’s degree in psychology, psychoeducation or remedial education has been obtained; and
ii.  that at least 9 credits in education have been earned in the teacher training program in general education in which the person is enrolled, including at least 3 credits in 3 of the 5 following categories: educational psychology, the teaching of a subject in the Basic school regulation for preschool, elementary and secondary education, class management, training on the Québec school system, or intervention with handicapped students or students with social maladjustments or learning disabilities; and
(2)  has a promise of employment from an employer referred to in section 29 certifying that, within the school year in progress, the person is to be given a general education teaching position directly related to the bachelor’s degree or training described in paragraph 1 for which a teaching licence is required and that the position cannot be filled by the holder of a teaching licence.

41. A provisional teaching licence to which section 40 refers is valid for a period of not more than 3 years and expires at the end of the second school year following the year in which it was issued.
It may be renewed for
(1)  a first period of 2 school years if its holder has earned at least 21 credits in education in the teacher training program in general education referred to in section 40;
(2)  a second period of 2 school years if its holder has earned at least 33 credits in education in the same program; and
(3)  a final period of one school year if its holder has earned at least 51 credits in education, including one practicum, in the same program.

42. A provisional general education teaching licence valid for a single period of not more than 4 years expiring at the end of the third school year following the year in which it was issued may be issued to a person who
(1)  is in either of the following situations:
(a)  is enrolled in a teacher training program in general education listed in Schedule I and is completing the third year of the program; or
(b)  has been awarded a partial diploma recognition pursuant to section 26;
(2)  has a promise of employment from an employer referred to in section 29 certifying that, within the school year in progress, the person is to be given a general education teaching position directly related to the bachelor’s degree or training described in paragraph 1 for which a teaching licence is required and that the position cannot be filled by the holder of a teaching licence.

DIVISION 2
TEACHING IN VOCATIONAL TRAINING

43. A provisional vocational training teaching licence may be issued to a person who is enrolled in a teacher training program in vocational training listed in Schedule II and the person is in either of the following situations:
(1)  has earned 90 credits in the teacher training program in vocational training including 60 credits in education and proves that
(a)  a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III has been obtained;
(b)  the person has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught; and
(c)  the language examination required by section 37 and, if applicable, the examination required by section 38 has been passed; or
(2)  has obtained a diploma of vocational studies, a diploma of college studies in a technical program, a university certificate comprising at least 30 credits or a university diploma directly related to the program to be taught in a sector of activities listed in Schedule III, and proves that
(a)  the person has a promise of employment from a school service centre, school board or private educational institution to which the Act respecting private education (chapter E-9.1) applies certifying that, within 12 months, the service centre, school board or private educational institution is to give the person a vocational training teaching position related to the person’s diploma and that the position cannot be filled by the holder of another teaching licence;
(b)  the person has a minimum of 3,000 hours of practical experience or teaching in a trade directly related to the program to be taught; and
(c)  three credits in pre-service vocational teacher training in a program listed in Schedule II have been earned.

44. A provisional vocational training teaching licence issued pursuant to paragraph 1 of section 43 is valid for not more than 6 years and expires at the end of the fifth school year following the year in which it was issued. It may be renewed for subsequent periods of 5 school years if its holder since the issuance of the licence or its last renewal has earned at least 15 additional credits from among those still required to obtain the diploma.
An applicant who is missing 3 additional credits from among the 15 required by the first paragraph may compensate for those credits by demonstrating that 250 hours have been taught for an employer referred to in section 29 if the hours are directly related to the training for which the provisional vocational training teaching licence has been obtained, or that 500 hours of relevant experience in the workplace have been accumulated.

45. A provisional vocational training teaching licence issued pursuant to paragraph 2 of section 43 is valid for not more than 4 years and expires at the end of the third school year following the year in which it was issued. It may be renewed for
(1)  a first period of 3 school years if its holder has earned at least 15 education credits in a teacher training program in vocational training listed in Schedule II;
(2)  a second period of 2 school years if its holder has earned at least 39 credits in the same program including not more than 9 credits for prior learning assessment for having practised the trade in the relevant sector of activities; and
(3)  a final period of 2 school years if its holder has earned at least 63 credits in the same program, including not more than 18 credits for prior learning assessment for having practised the trade in the relevant sector of activities.

46. A provisional general education teaching licence for the Cree and Kativik school boards may be issued to a student who has successfully completed the second practicum in the Certificate in Education for First Nations and Inuit referred to in paragraph 0.1 of section 8.

48. A provisional teaching licence to provide preschool education services may be issued to a person who
(1)  is enrolled in a teacher training program in preschool education recognized since September 2001 and listed in Schedule I and has earned at least 9 credits in education in the program including at least 3 credits in 3 of the 5 following categories: educational psychology, the teaching of a subject in the Basic school regulation for preschool, elementary and secondary education, class management, the Québec school system, or intervention with handicapped students or students with social maladjustments or learning disabilities;
(2)  has obtained a diploma of college studies in early childhood education and an equivalent training listed in Schedule VII;
(3)  has a relevant working experience of 3,000 hours as a preschool service educator or teacher; and
(4)  has a promise of employment from an employer referred to in section 29 certifying that, within the school year in progress, the person is to be given a preschool teaching position and that the position cannot be filled by the holder of a teaching licence.

49. A provisional teaching licence to provide preschool education services to which section 48 refers is valid for a period of not more than 4 years and expires at the end of the third school year following the year in which it was issued.
It may be renewed for
(1)  a first period of 3 school years if its holder has earned at least 54 education credits in the teacher training program, including one practicum, referred to in section 48;
(2)  a second period of 2 school years if its holder has earned at least 90 credits, including 2 practicums, in the same program; and
(3)  a final period of one school year if its holder has earned at least 114 credits, including 3 practicums, in the same program.

EXPIRY OF A PROVISIONAL TEACHING LICENCE

50. Every provisional teaching licence ceases to have effect as soon as its holder fails the second practical training period that is part of the required teacher training program to be completed, or is expelled from, withdraws from or otherwise ceases to be enrolled in the program, unless the university has agreed to suspend the holder’s enrollment.
Except where enrolment is suspended, the holder of a provisional teaching licence must notify the Minister as soon as the holder is in a situation described in the first paragraph.

CHAPTER 6
APPLICATION, ISSUANCE AND RENEWAL PROCEDURE FOR TEACHING LICENCES AND REGISTER OF TEACHING LICENCE HOLDERS

APPLICATION, ISSUANCE AND RENEWAL OF TEACHING LICENCES

51. Every person applying for a teaching licence must provide the Minister with the following information and documents:
(1)  the person’s name, address, telephone number and if available, email address;
(2)  a certified copy of the person’s act of birth or birth certificate and if applicable, proof of change of name or, if it not possible to provide those documents, an affidavit explaining why they cannot be provided, and the person’s date and place of birth;
(3)  if the person was born outside Canada, proof of citizenship and that the person is a permanent resident or is authorized to work in Canada;
(4)  a copy of the person’s relevant diplomas, the licence to teach outside Québec, if applicable, and any other document relevant to consideration of the application and establishing proof of the person’s training and experience, such as a transcript, a document attesting to successful completion of training or an examination, a credential evaluation report issued by a competent body, a letter from an employer or any other proof of experience or teaching hours accumulated;
(5)  a promise of employment when required under this Regulation;
(6)  any decision of an authority in a province, territory or State or of an organization subjecting the practice of teaching to conditions;
(7)  the language in which the person received the training in support of the application; and
(8)  the judicial record declaration required by section 25.1 of the Education Act (chapter I-13.3).

52. Every copy of a diploma, teaching licence, transcript or attestation of successful completion of training or an examination provided pursuant to this Chapter must be certified by the authority issuing the original document, unless the applicant proves that such certification is impossible to obtain, in which case a copy and an affidavit from the applicant to the effect that the copy is true to the original may be provided.
Every document provided pursuant to this Chapter and written in a language other than French or English must be accompanied by a French or English translation certified by a member of the Ordre professionnel des traducteurs, terminologues et interprètes agréés du Québec.

53. The Minister is to issue a teaching licence to any person who qualifies for the licence.
In addition to its title, the teaching licence must state
(1)  the identification number assigned to it;
(2)  the name of the holder;
(3)  the issue date and, if applicable, the expiry date;
(4)  if applicable, the fact that the holder is required to successfully complete a probationary period or supplementary training;
(5)  the language or languages of instruction in which the holder is proficient, after passing an examination required by this Regulation;
(6)  for a general education teaching licence, the levels authorized and if applicable, the subject for which the holder has been trained; and
(7)  for a vocational training teaching licence, the sector of activity listed in Schedule III corresponding to the holder’s training;
(8)  for a general education teaching licence for Cree and Kativik school boards, the school boards concerned.

54. Every applicant for renewal of a probationary permit or a provisional teaching licence must provide the Minister with the information and documents showing the applicant satisfies the conditions for renewal of the probationary permit or provisional teaching licence.
The Minister may renew a teaching licence that has expired.

55. Before refusing a licence application or revoking or refusing to renew a licence, the Minister must notify the applicant or holder in writing as prescribed by section 5 of the Act respecting administrative justice (chapter J-3) and allow the applicant or holder at least 10 days to submit observations.
A person who has had a licence application or an application for renewal refused may not submit the same application again unless it is supported by at least one new element.
A person who has had a licence revoked or has had a licence renewal refused may not submit a new licence application unless it is supported by elements other than those that allowed the person to obtain the initial teaching licence.

56. The Minister is to establish a register of holders of valid teaching licences in which the particulars referred to in section 53 are to appear.
The Minister is to make the register available to school service centres, school boards and the institutions governed by the Act respecting private education (chapter E-9.1), and to the authorities in the other Canadian provinces or territories responsible for the issuance of teaching licences.

CHAPTER 7
TRANSITIONAL AND FINAL

57. This Regulation replaces the Regulation respecting teaching licences (chapter I-13.3, r. 2).

58. Sections 59 to 62 apply to holders of valid teaching licences issued before 1 October 2019.

59. All teaching diplomas issued under the Regulation respecting teaching licences (chapter I-13.3, r. 2) and valid on 30 September 2019 remain valid.
The teaching licences issued under the Regulation respecting teaching licences and valid on 30 September 2019 are deemed to have been issued under this Regulation and correspond to the teaching licences established under the new Regulation in the following manner:
(1)  a teaching permit issued under paragraph 5 of section 3 of the former Regulation is deemed to be a general education teaching diploma issued under section 6 of this Regulation;
(2)  a teaching authorization issued under section 10.1 of the former Regulation is deemed to be a vocational training teaching diploma issued under section 7 of this Regulation;
(3)  a teaching permit issued under paragraph 1 of section 3 of the former Regulation is deemed to be a probationary general education teaching permit issued under paragraph 1 of section 10 of this Regulation;
(4)  a teaching permit issued under paragraph 3 or 4 of section 3 of the former Regulation is deemed to be a probationary general education teaching permit issued under paragraph 2 of section 10 of this Regulation;
(5)  a teaching permit issued under paragraph 2 of section 3 of the former Regulation is deemed to be a probationary general education teaching permit issued under paragraph 3 of section 10 of this Regulation;
(5.1)  a teaching permit issued under section 61 or 62 of the former regulation is deemed to be a probationary vocational training teaching permit issued under paragraph 0.1 of section 15 of this Regulation;
(6)  a teaching permit issued under section 11.1 or 11.2 of the former Regulation is deemed to be a probationary vocational training teaching permit issued under paragraph 1 of section 15 of this Regulation;
(7)  a teaching permit issued under section 11 of the former Regulation is deemed to be a probationary vocational training teaching permit issued under paragraph 2 of section 15 of this Regulation;
(8)  a teaching permit issued under section 4 of the former Regulation is deemed to be a probationary general education teaching permit for Cree and Kativik school boards issued under section 19 of this Regulation;
(9)  a provisional teaching authorization issued under section 46 of the former Regulation is deemed to be a provisional general education teaching licence issued under section 40 of this Regulation;
(10)  a provisional teaching authorization issued under section 48 of the former Regulation is deemed to be a provisional general education teaching licence issued under section 42 of this Regulation;
(11)  a teaching authorization issued under section 9 or 10 of the former Regulation is deemed to be a provisional vocational training teaching licence issued under paragraph 1 of section 43 of this Regulation;
(12)  a provisional teaching authorization for vocational training issued under section 8 of the former Regulation is deemed to be a provisional vocational training teaching licence issued under paragraph 2 of section 43 of this Regulation;
(13)  a provisional teaching authorization in general education issued under section 2.1 of the former Regulation is deemed to be a provisional general education teaching licence for the Cree and Kativik school boards issued under section 46 of this Regulation.
A teaching diploma issued under subparagraph 3 of the first paragraph of section 7 of the former regulation enabling teaching in general education at the Kativik School Board also enables teaching at the Cree School Board as if issued under section 8 of this Regulation.

60. All licences and authorizations issued under the Regulation respecting teaching licences (chapter I-13.3, r. 2), valid on 30 September 2019 and having a later expiry date, expire on the date they were to expire under that Regulation. Despite the foregoing, a licence or authorization that is to expire before 30 June 2021 is deemed to expire on that date.
Renewal of a teaching licence or authorization issued under the former Regulation is, if applicable, subject to the relevant rules set out in this Regulation.
Despite the foregoing, if the application of a rule set out in this Regulation operates to prevent the renewal of a licence or authorization that would have otherwise been renewable under the former Regulation, the renewal rules of the former Regulation apply but only to the first renewal following the coming into force of this Regulation (2019-10-01).
The third paragraph, adapted as required, also applies to an initial application for a teaching licence that was being processed on 30 September 2019, and to the first renewal of a teaching licence issued pursuant to this paragraph.

61. Subject to the special rules in the second and third paragraphs, the issuance conditions for a teaching diploma set out in this Regulation apply to holders of probationary permits referred to in the second paragraph of section 59. In particular, a holder of a teaching licence issued without conditions in another Canadian province or territory may be issued an equivalent teaching diploma in accordance with the provisions of this Regulation without being required to prove the conditions under the former Regulation have been met.
A holder of a teaching licence issued subject to conditions in another Canadian province or territory may be issued an equivalent teaching diploma after demonstrating that conditions equivalent to those imposed on the holder in the other Canadian province or territory or under the former Regulation have been met.
A person who began to serve a probationary period before 1 October 2019 remains subject, for the remainder of that period, to the provisions of the Regulation respecting teaching licences (chapter I-13.3, r. 2), except that this Regulation applies to a person who begins to serve a second probationary period after that date.

62. Section 51 of the Regulation respecting teaching licences (chapter I-13.3, r. 2) continues to apply to holders of a teaching permit issued pursuant to section 50 of that Regulation. The reference to Schedule II must consequently be read as a reference to Schedule I to this Regulation.
Section 57 of the Regulation respecting teaching licences continues to apply to holders of a teaching permit issued pursuant to section 56 of that Regulation.
Section 66 of the Regulation respecting teaching licences continues to apply to holders of a teaching permit issued pursuant to section 65 of that Regulation. The reference to Schedule V must consequently be read as a reference to Schedule II to this Regulation.

63.1. Up to 30 June 2025, a provisional general education teaching licence referred to in section 40 may be issued to an applicant who does not meet the condition provided for in subparagraph iii of subparagraph a or in subparagraph ii of subparagraph b of paragraph 1.
Up to that same date, the provisional licence may also be issued to an applicant who has earned only 15 of the 45 university-level credits provided for in subparagraph ii of subparagraph a of the same paragraph.

63.2. Up to 30 June 2025, a provisional vocational training teaching licence referred to in paragraph 1 of section 43 may be issued to an applicant who has earned only 45 of the 60 credits required in the teacher training program, if the applicant meets the other conditions set out in that section.

63.3. Up to 30 June 2025, section 50 does not apply to the holder of a provisional vocational training teaching licence referred to in section 43 of this Regulation who, on 30 September 2019, held a teaching authorization for vocational training without being enrolled in a teacher training program in vocational training.
Notwithstanding the first paragraph, section 50 applies to such a holder of a provisional vocational training teaching licence referred to in section 43 of this Regulation as soon as that holder is once again admitted to such a program.
