31.0.10. This subdivision does not have the effect of restricting any power the Minister may exercise where an activity for which a declaration of compliance was filed under this subdivision is carried out in contravention of this Act or the regulations.
In addition, a person that carries on an activity in contravention of the conditions, restrictions or prohibitions that must be complied with for the activity to be eligible for a declaration of compliance and determined in a regulation made under section 31.0.6 is deemed to carry on the activity without the authorization required under subdivision 1 and is liable to the remedies, penalties, fines and other measures applicable in such a case.
31.0.10. This subdivision does not have the effect of restricting any power the Minister may exercise where an activity for which a declaration of compliance was filed under this subdivision is carried out in contravention of this Act or the regulations.
