chapter R-6.01, r. 3.01
Regulation respecting gas from renewable sources
Act respecting the Régie de l’énergie
(chapter R-6.01, s. 112, 1st. par., subpars. 4 and 5).
The former alphanumerical designation of this Regulation was chapter R-6.01, r. 4.3.
O.C. 233-2019; O.C. 1587-2022, s. 1; S.Q. 2025, c. 24, ss. 124 and 174.
0.1. For the purposes of the Act respecting the Régie de l’énergie (chapter R-6.01) and this Regulation, renewable natural gas means gas that is produced
1°  from non-fossil organic materials degraded by means of biological processes, in particular by anaerobic digestion, or by means of thermochemical processes, in particular by gasification; or
2°  from hydrogen produced in accordance with subparagraph 3 of the second paragraph and from non-fossil carbon monoxide or carbon dioxide.
Likewise, gas from renewable sources means
1°  renewable natural gas referred to in the first paragraph;
2°  biogas produced from non-fossil organic materials degraded by means of biological processes, in particular by anaerobic digestion, and composed of methane and carbon dioxide as well as of other components; and
3°  hydrogen that is produced
a)  from non-fossil organic materials degraded by means of thermochemical processes, in particular by gasification;
b)  by the electrolysis of water using electricity that comes exclusively from renewable energy sources; or
c)  during an industrial process, the purpose of which is not to obtain the hydrogen and which is powered by energy that comes exclusively from renewable sources.

1. Natural gas distributors must, by the operation of its natural gas distribution system or by a means provided for in section 79.1 of the Act respecting the Régie de l’énergie (chapter R-6.01), distribute annually, for final consumption in the territory for which the distributor obtained exclusive distribution rights, a minimum quantity of gas from renewable sources equal to or greater than the result of the following formula:
T ×(LRA3 + LRA2 + LPA1)
3
In the formula provided for in the first paragraph,
1°  the variable “T” represents
a)  a rate of 0.01 as of the distributor’s rate year beginning in 2020;
b)  a rate of 0.02 as of the distributor’s rate year beginning in 2023;
c)  a rate of 0.05 as of the distributor’s rate year beginning in 2025;
d)  a rate of 0.07 as of the distributor’s rate year beginning in 2028; and
e)  a rate of 0.1 as of the distributor’s rate year beginning in 2030.
2°  the variable “LRA3” represents the total actual volume of natural gas distributed by the distributor to the major enterprise market and the small and medium flow market for the third rate year preceding the current year;
3°  the variable “LRA2” represents the total actual volume of natural gas distributed by the distributor to the major enterprise market and the small and medium flow market for the second rate year preceding the current year;
4°  the variable “LPA1” represents the total estimated volume to be distributed by the distributor to the major enterprise market and the small and medium flow market for the rate year preceding the current year.
The result of the formula and the variables described in subparagraphs 2 to 4 of the second paragraph are in million cubic metres (Mm3).
Where the gas from renewable sources distributed by a distributor is hydrogen produced in accordance with subparagraph 3 of the second paragraph of section 0.1, only 33 1/3% of that hydrogen may be computed in the calculation of total volumes represented by the variables LRA3, LRA2 and LPA1, and in the calculation of the quantity of gas from renewable sources that the distributor distributes to meet its requirement provided for in this section.
In addition, where the gas from renewable sources distributed by a distributor is biogas produced in accordance with subparagraph 2 of the second paragraph of section 0.1, only methane may be computed in the calculation of total volumes represented by the variables LRA3, LRA2 and LPA1, and in the calculation of the quantity of gas from renewable sources that the distributor distributes to meet its requirement provided for in this section.
