Tariff of fees respecting the register of personal and movable real rights

Act respecting registry offices

(chapter B-9, s. 8).

The Tariff of fees respecting the register of personal and movable real rights (chapter B-9, r. 2) is replaced by Schedule II to the Act respecting registry offices (chapter B-9) enacted by section 63 of the Act respecting mainly the implementation of certain provisions of the Budget Speech of 17 March 2011 and the enactment of the Act to establish the Northern Plan Fund (2011, chapter 18).

The sums paid in fees, duties and costs under the Tariff are deemed to be fees, duties and costs validly collected under the first paragraph of section 317 of chapter 18 of the statutes of 2011. Those sums belong to the Government.

1. The fee for the registration of a right mentioned in an application which, according to law, must fix the date after which registration ceases to be effective is $27.25 per application, plus fees for the duration of the publication equal to $3 per year or fraction of a year of intended publication, up to $15.

In addition, in computing the fee for the registration of the renewal of the publication of a right, the fees for the duration of the intended publication shall be multiplied by the number of registration numbers indicated under the heading “Reference to registration in the register of personal and movable real rights” on the appropriate form.

1.1. The fee for the registration of a right mentioned in an application that does not have to specify the date after which registration ceases to be effective or for the registration of a correction in an entry is $42.50 per application.

2. The fee for the registration of an address or for a change or alteration in a beneficiary’s name, address or fax number is $42.50 per application.

2.1. The fees exigible under sections 1, 1.1 and 2 shall be reduced by $8 per application where the application is presented by electronic means.

3. Notwithstanding sections 1 and 1.1, no fee is exigible to register:

1°  a judgment, as notified by the court clerk pursuant to article 817.2 of the Code of Civil Procedure (chapter C-25);

2°  a marriage contract referred to in article 442 of the Civil Code;

3°  a correction with regard to the rights referred to in paragraphs 1 and 2;

4°  a cancellation or reduction of a registration; or

5°  a right mentioned in an application presented in the form of a notice made on the form RZ “Application for registration of a reservation of ownership, rights under a lease or certain other rights — Transitional law”.

6. The fee for a statement of a particular entry, certified by the registrar and issued in accordance with article 3019 of the Civil Code, is $5.05.

7. The fee for a statement of the rights registered in the register, certified by the registrar, is,

1°  if the statement is made under the name of a natural person, $12.20 per name for a given date of birth;

2°  if the statement is made under a name other than that of a natural person, $12.20 per name; and

3°  if the statement is made under the identification number of a road vehicle, $12.20 per identification number.

8. The fee for the issue by the registrar of a copy of or extract from an application for registration or a memorial of presentation is $5.05 per copy or extract.

This fee is doubled where the copy or extract is certified by the registrar.

8.1. Notwithstanding sections 6 and 8, no fee is exigible for the issue pursuant to section 46.1 of the Regulation respecting the register of personal and movable real rights (O.C. 1594-93, 93-11-17) of a statement or copy certified by the registrar.

9. The fee for any other certificate is $5.05, unless the law expressly provides that no fees are to be collected or that specific fees are fixed.

10. A fee of $5.05 per document shall be added to the fees provided for in sections 6, 7 and 8 where a statement, copy or extract is sent by fax.

11. The fee for the issue of statistical reports is $1.75 per second during which the computer is in use; however, the fee may not be less than $101.

13.1. The fee exigible for consulting the register for a name is $8.10 per name or, in the case of a natural person, $8.10 per name coupled to a date of birth.

13.2. The fee exigible for consulting the register using the identification number of a road vehicle is $3 per number.

13.3. The fee exigible for consulting a specific entry in the register using its number or the form number of the application whereby that entry was made is $3 per number.

13.4. The fee exigible for consulting the list of adresses using a name is $3 per name or, in the case of a natural person, $3 per name coupled to a date of birth.

13.5. The fees exigible under sections 13.1 to 13.4 shall be increased by $3 per name or per number where the register or the list of addresses is consulted by telephone.
