S-25.01 - Act respecting mixed enterprise companies in the municipal sector

55. The shareholders of a mixed enterprise company may dismiss any director who has contravened section 54. A dismissal requires a majority vote of all shareholders present at a special general meeting of the shareholders called for that purpose before the expiry of one year from the date on which the act is alleged to have been committed.

55. The shareholders of a mixed enterprise company may dismiss any director who has contravened section 54. Notwithstanding the second paragraph of section 123.77 of the Companies Act (chapter C-38), a dismissal requires a majority vote of all shareholders present at a special general meeting of the shareholders called for that purpose before the expiry of one year from the date on which the act is alleged to have been committed.
