108. Only one surviving spouse’s pension and one death benefit may be paid under this Act in respect of a deceased contributor.

108. Only one surviving spouse’s pension may be paid under this Act in respect of a deceased contributor.

108. Where a person whose spouse has died remarries at a time when no surviving spouse’s pension is payable to him, no such pension is payable to him during the period of his remarriage.
If, following the death of his spouse of that or any subsequent remarriage, a surviving spouse’s pension becomes payable to him, his deceased spouse for the purposes of such pension is deemed to be the person named in the application.
