40. The participant who, during a term entitling him to qualify for a pension under the pension plan by which he then benefits, ceases to hold office as a member of the council following the amalgamation or annexation of the municipality of which he is a member, may continue to benefit by such plan until the end of the term for which he had been elected and he must, as must the new municipality resulting from the amalgamation or the annexing municipality, as the case may be, discharge the obligations resulting from such plan until the date when the term of the participant would have ceased otherwise.
For the purposes of this section, the pensionable salary is the one received by the participant upon ceasing to hold office as member of the council following the amalgamation or annexation thereof.
