R-12 - Act respecting the Civil Service Superannuation Plan

83. An officer who ceases to participate in the plan provided for in this division after 10 years of service and before he is eligible for a pension is entitled to only a deferred pension, unless
(1)  his years and parts of a year of service are transferred to the Teachers Pension Plan, the Government and Public Employees Retirement Plan, the Pension Plan of Management Personnel, the Pension Plan of Certain Teachers or to the Pension Plan of Peace Officers in Correctional Services;
(2)  he comes under a transferability agreement concerning the plan contemplated in this division, made under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

83. A public servant who ceases to hold a position or employment after ten years of service and before he qualifies for a pension is entitled to only a deferred pension, unless
(1)  he transfers his years of service to the Teachers Pension Plan or to the Government and Public Employees Retirement Plan;
(2)  he comes under a transferability agreement concerning the plan contemplated in this division, made under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

83. An officer who resigns or is dismissed or whose office is abolished after ten years of service and before he qualifies for a pension is entitled to only a deferred pension, unless
(1)  he transfers his years of service to the Teachers Pension Plan or to the Government and Public Employees Retirement Plan;
(2)  he comes under a transferability agreement concerning the plan contemplated in this division, made under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

83. If an officer or employee resign or be dismissed, or if his office be abolished or if he be compelled, through physical or mental infirmity, to leave the service before the time when a pension could be granted to him, the sums which have been deducted from his salary shall be returned to him, without interest.
If the officer or employee contemplated in the first paragraph is again employed by a body contemplated in this division within 180 days from the date his employment was terminated and if he has not been reimbursed the sums deducted from his salary, he may elect to be reimbursed the said sums or to be credited with the service he has accumulated.
If the functionary or employee contemplated in the first paragraph subsequently becomes a member, he is entitled to a pension for the years during which he was a functionary or employee, provided he acquires the right to a member’s pension; such pension shall be deferred until he begins to receive a pension under the Legislature Act (chapter L-1) or the Act respecting the conditions of employment and the pension plan of the Members of the National Assembly (chapter C-52.1) provided he remits his contributions if they have been reimbursed to him. This paragraph applies to every member of the National Assembly who has or will have been governed by this Act or who has or will have been a teacher within the meaning of the Act respecting the Teachers Pension Plan (chapter R-11).
If he dies before he is granted a pension and a pension provided for in sections 77 and 78 is not payable, the deductions from his salary shall be returned to his legal representatives.

83.
