47. Every permit holder who infringes the operating hours fixed in accordance with section 34, a regulation made under subparagraph k of section 40, the conditions or restrictions indicated in his permit is liable
(a)  for a first offence, to a fine of not less than $700 nor more than $2 800;
(b)  for any subsequent conviction, to a fine of not less than $2 800 nor more than $7 000.
Section 52 does not apply to such offences.
