38. (Repealed).

38. In proceedings for an offence under section 7, paragraph 2 of section 9 or section 10 or 16, the producer, dealer, carrier or consignee, as the case may be, who was in possession of potatoes which have been the object of a notice under section 5 or 8 is presumed, in the absence of any evidence to the contrary, to have intended them for planting.

38. In any proceedings for an offence under section 7, paragraph 2 of section 9 or section 10 or 16, the burden of proof is on the person in possession of potatoes which have been the object of a notice provided for in section 5 or 8 that the potatoes are not intended for planting.
