41. The notary must verify the identity of the parties who sign before him by any reasonable means allowing him to establish their identity.
When one of the parties signs before a notary other than the officiating notary in accordance with paragraph 2 of section 40, it is incumbent on that other notary to verify the identity of the party concerned.

41. (1)  The notary must know the identity of the parties who sign before him; if not, such identity must be certified to him by a person of full age whom he knows, who shall intervene in the deed for such purpose and sign it.
(2)  When a party signs before a notary other than the officiating notary, the identity of the party concerned shall be sufficiently established by the signature, after that of the said party, of a person known to such other notary, with an indication that the signature of such person was given for the purpose of identifying the said party, the signatures of the party and of the person who identifies him being attested by the notary as provided in subsection 2 of section 40.
