9. Every member of the council who, either verbally or in writing, by his vote or tacitly, authorizes the misapplication of such money, shall be personally responsible towards the municipality for all sums thus illegally diverted from the use for which they are intended.

Every member of the council who, either verbally or in writing, by his vote or tacitly, authorizes the misapplication of such money, shall be personally responsible for all sums thus illegally diverted from the use for which they are intended, towards the corporation, which may recover the same by an action at law, enforceable by coercive imprisonment against the member or the members of the council in default.
