40. The functions of the Conseil are to assist the Minister in keeping up to date the list contemplated in section 4 and for that purpose to give him its advice on the therapeutic value of each medication and the fairness of the price exacted.
In the exercise of its functions the Conseil may require from recognized manufacturers and wholesalers, or those applying to be recognized, pharmacotherapeutic information concerning a medication or any information relating to the price of medications it offers for sale.
The Conseil may have access to the information obtained by the Board for the purposes of section 20 of the Act respecting the Régie de l’assurance-maladie du Québec (chapter R-5) where the information is needed by the Conseil for the purposes of sections 4.3 and 4.5. No such information may be obtained if it allows a beneficiary to be identified.
