R-13, r. 1 - Regulation respecting the water property in the domain of the State
Section 23
Versions
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $350;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $70.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $70 per hectare, without being lower than $70.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $346;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $69.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $69 per hectare, without being lower than $69.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $339;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $68.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $68 per hectare, without being lower than $68.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $332;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $67.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $67 per hectare, without being lower than $67.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $327;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $66.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $66 per hectare, without being lower than $66.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $322;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $65.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $65 per hectare, without being lower than $65.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $318;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $64.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $64 per hectare, without being lower than $64.
23. A part of the water property may not be leased at an annual rent lower than the following rents:
(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $313;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $63.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $63 per hectare, without being lower than $63.

(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $310;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $62.
Despite the first paragraph, where the lease is granted to a municipality or a body for non-profit use that facilitates public access to bodies of water, excluding a marina, the minimum annual rent is $62 per hectare, without being lower than $62.

(1) if the lease allows the lessee to carry on activities for profit, the higher of
(a) 10% of the value of the part of the water property under lease; and
(b) $304;
(2) where only non-profit activities are authorized, the higher of
(a) 5% of the value of the part of the water property already occupied or that will be occupied by a work or structure, and 2% of the value of the other parts of the water property under lease; and
(b) $61.
