Regulation 1 respecting the signing of certain deeds, documents or writings of the Ministère de la Santé et des Services sociaux

Act respecting the Ministère de la Santé et des Services sociaux

(chapter M-19.2, s. 8).

1. The officers of the Ministère de la Santé et des Services sociaux holding the positions mentioned in this Regulation, permanently or on an acting basis, are authorized to sign alone, within the limits of their respective attributions and with the same authority as the Minister of Health and Social Services, the deeds, documents or writings described in respect of their positions, subject to the conditions set forth in the Financial Administration Act (chapter A-6.001).

1.1. The Director General of the Direction générale de la coordination, du financement, de l’équipement et des ressources informationnelles, the Director of the Direction des investissements and the Head of the Service des investissements et du financement are authorized to sign the following documents:

(1)  authorizations for loans taken out by a health and social services agency or a public institution to finance capital expenditures or the debt service, and the terms and conditions pertaining to such loans, in accordance with section 296 or 396 of the Act respecting health services and social services (chapter S-4.2);

(2)  promises or grants of subsidies to a health and social services agency or a public institution to provide for the payment of their loans referred to in paragraph 1, and the related terms and conditions, in accordance with section 468 of that Act;

(3)  authorizations for loans taken out by the Cree Board of Health and Social Services of James Bay established under the Act respecting health services and social services for Cree Native persons (chapter S-5) that relate to their capital expenditure fund, and the related terms and conditions, in accordance with section 178.0.1 of that Act;

(4)  promises or grants of subsidies to the James Bay Cree health and social services council to provide for the payment of their loans referred to in paragraph 3, and the related terms and conditions, in accordance with section 178.0.2 of that Act.

2. The following officers are authorized to sign any deed, document or writing to hypothecate or assign, to a trustee appointed under a trust deed or under a trust agreement or, as the case may be, to a lender, to the lender’s mandatary or to the assignee of the lender’s rights, the subsidies granted by Government order in council or by the Minister, as the case may be, out of the appropriations of the Ministère de la Santé et des Services sociaux in order to guarantee the principal and interest of bond issues, of borrowings obtained from the Minister of Finance in his capacity as manager of the financing fund or of any other type of borrowing of a health and social services agency or a public institution referred to in the Act respecting health services and social services (chapter S-4.2), of the Cree Board of Health and Social Services of James Bay, of the Société québécoise des infrastructures, or of any other agency under the jurisdiction of the Minister of Health and Social Services:

(1)  the Director General of the Direction générale de la coordination, du financement, de l’équipement et des ressources informationnelles ;

(2)  the Director of the Direction des investissements ;

(3)  the Head of the Service des investissements et du financement ;

(4)  Nicole Laliberté of the Direction des investissements ;

(5)  Charles Hardy of the Direction générale adjointe aux ententes de gestion.

2.1. The Director General of the Direction générale de la coordination, du financement , de l’équipement et des ressources informationnelles and the Assistant Director General of the Direction générale adjointe au budget are authorized to sign the authorization to borrow for a public institution to meet operating expenditures, in accordance with section 13 of the Act to provide for balanced budgets in the public health and social services network (chapter E-12.0001).

3. A facsimile of the signature of the Minister or Deputy Minister of Health and Social Services may be used on the certificate appearing on the wording of the bonds referred to in section 2 and attesting that the payment of those bonds is garanteed by a subsidy of the Government.
