C-61.1 - Act respecting the conservation and development of wildlife

110. With regard to a controlled zone, the Government may, by regulation,
(1)  authorize or prohibit a recreational, hunting or fishing activity, on the conditions it determines;
(2)  set the fees or maximum fees payable to carry on a recreational, hunting or fishing activity, to register for a draw or to travel about the territory;
(3)  authorize or prohibit the use of recreational vehicles on the conditions it determines;
(4)  set the maximum number or the categories of persons that may carry on a recreational, hunting or fishing activity in a sector of the territory, on the conditions it determines;
(5)  authorize or prohibit the carrying, possession or transport of hunting or fishing gear on the conditions it determines;
(6)  authorize or prohibit the presence of a dog or other domestic animal on the conditions it determines;
(7)  divide the territory into sectors for the purposes of the standards prescribed under this section, which may vary according to the sector;
(8)  determine the minimum and maximum fees payable for membership in an agency that is party to a memorandum of agreement; and
(9)  allow any agency that is party to a memorandum of agreement to exercise all or some of the regulatory powers provided for in subparagraphs 1 to 4 and subparagraphs 7 and 8, on the conditions it determines.
The amount of fees exigible that may be determined under this section may vary according to the category of persons or class of licence concerned, the age of the persons, the activity carried on, the species of wildlife hunted or fished, the period of the stay, the sector or the place, or the period or date of the recreational, hunting or fishing activity.

110. The Government may, by regulation, in respect of controlled zones,
(1)  determine the conditions on which hunting, fishing and trapping activities are permitted and fix the maximum fees exigible for the practice of these activities;
(2)  determine the registration procedures with which a person who, for recreational purposes, has access to or stays in the territory or engages therein in any activity must comply;
(2.1)  determine the conditions that must be complied with by a person who, for recreational purposes, enters or travels about a controlled zone or engages there in any activity, or prohibit such activities;
(3)  determine the categories of persons who are required to pay a fee to travel about the territory and the maximum amount of the fee exigible for that purpose;
(4)  determine the conditions governing the use of a vehicle or access by boat, motor-boat or aircraft for recreational purposes, or prohibit the use of or access by certain types thereof, or determine the conditions or procedures governing the authorization to use a vehicle or to have access by aircraft, boat or motor-boat, for recreational purposes, or any prohibition of such use or access; the conditions or procedures may vary according to the type of vehicle, aircraft or boat, the date or place they are used or the date or place where access thereby is authorized;
(5)  determine the types of engines permitted for boats, or prohibit certain types thereof;
(5.1)  divide the territory into sectors for hunting, fishing or trapping purposes or for the purposes of other recreational activities, or determine the conditions or procedures governing the division of a territory into such sectors, and establish the conditions or procedures governing the authorization or prohibition of any hunting, trapping or other recreational activity according to the sector, the species of wildlife sought, the age or the sex of the animals, the means used to carry on an activity or the date on which an activity is carried on;
(5.2)  fix the maximum number of persons who may hunt, fish or trap in any sector of the territory or establish the mode of assignment of persons, an undertaking, agency or association to a sector or determine the conditions or procedures applicable in such cases;
(5.3)  determine the maximum and minimum amounts of fees exigible for membership by an agency that is a party to a memorandum of agreement;
(5.4)  determine, according to the categories of persons concerned or according to the time of year, conditions for the carrying, possession or transportation of hunting, fishing or trapping implements, or prohibit such implements;
(6)  permit any agency that is a party to a memorandum of agreement
(a)  to determine the cases where the registration of persons is required;
(b)  to establish, within the maximum amounts fixed by regulation of the Government, the amount of the fee exigible to travel about the territory or to carry on hunting, fishing or trapping activities;
(c)  to determine the types of vehicles, boats or aircrafts the use of or access by which, for recreational purposes, is authorized or prohibited, or determine the types of engines permitted for boats or prohibit certain types thereof in accordance with the conditions or procedures prescribed by regulation of the Government;
(d)  to divide the territory into sectors for hunting, fishing or trapping purposes, or for the purposes of other recreational activities and authorize or prohibit any hunting, trapping or other recreational activity within the sectors, in accordance with the conditions or procedures prescribed by regulation of the Government;
(e)  to fix the maximum number of persons who may hunt, fish or trap in the sectors it has determined, or to establish the mode of assignment of persons or of an undertaking, agency or association to any sector, in accordance with the conditions or procedures prescribed by regulation of the Government.
The amount of fees exigible that may be determined under this section may vary according to the category of persons or licences concerned, the age of the persons, the activity carried on, the species of wildlife sought, the period of the stay, the sector or the place, or the period or date of the hunting, fishing or trapping activity.

(5.4)  determine, according to the categories of persons concerned or according to the time of year, conditions for the carrying, possession or transportation of hunting, fishing or trapping implements, or prohibit such implements;
(6)  permit any agency that is a party to a memorandum of agreement
(a)  to determine the cases where the registration of persons is required;

(5.2)  fix the maximum number of persons who may hunt, fish or trap in any sector of the territory or establish the mode of assigning persons to a sector or determine the conditions or procedures governing the fixing of the maximum number of persons who may hunt, fish or trap in a sector of the territory, or the establishment of the mode of assignment of persons to any sector;
(5.3)  determine the maximum and minimum amounts of fees exigible for membership by an agency that is a party to a memorandum of agreement;
(5.4)  determine, according to the categories of persons concerned or according to the time of year, conditions for the carrying, possession or transportation of hunting, fishing or trapping implements, or prohibit such implements;
(6)  permit any agency that is a party to a memorandum of agreement
(a)  to determine the cases where the registration of persons is required;
(b)  to establish, within the maximum amounts fixed by regulation of the Government, the amount of the fee exigible to travel about the territory or to carry on any activity;
(c)  to determine the types of vehicles, boats or aircrafts the use of or access by which, for recreational purposes, is authorized or prohibited, or determine the types of engines permitted for boats or prohibit certain types thereof in accordance with the conditions or procedures prescribed by regulation of the Government;
(d)  to divide the territory into sectors for hunting, fishing or trapping purposes and authorize or prohibit any hunting, fishing or trapping activity within the sectors, in accordance with the conditions or procedures prescribed by regulation of the Government;
(e)  to fix the maximum number of persons who may hunt, fish or trap in the sectors it has determined, or to establish the mode of assignment of persons to any sector, in accordance with the conditions or procedures prescribed by regulation of the Government.
