69. A reserve shall prohibit, during its term, any construction, improvement or addition on the immovable affected by it, except repairs. If the immovable is expropriated before the expiry of the term, the appraisal for indemnity must be established according to the date of the expropriation, but without taking into account the increased value attributable to the establishment of the reserve, the expropriation or the carrying out of the public works following the expropriation.
The object of the reserve may also be the establishment of a servitude of prohibition of access or other real servitude. The damages occasioned by the subsequent establishment of the servitude are determined on the date of the establishment of the reserve.
