198. If, within a year from the death, resignation or dismissal of the secretary-treasurer, or if, within a year following the 30 days after the service of the notice of the withdrawal of the security for the future, by the surety, it does not appear that the secretary-treasurer has been guilty of negligence, misconduct or malversation, the security given is extinguished.
In the above cases the moneys or debentures pledged are afterwards returned, or the hypothec cancelled, as the case may be.
The secretary-treasurer and his representatives remain personally liable, however, in accordance with the Civil Code of Lower Canada, for the damages arising from his negligence, misconduct or malversation.
