R-9.2 - Act respecting the Pension Plan of Peace Officers in Correctional Services

56. From the day the payment of the pension of a pensioner ceases by reason of death or, as the case may be, from the day of the death of an employee entitled a pension, their spouse shall be entitled to receive as pension for life one-half of the pension the pensioner was receiving or, as the case may be, would otherwise have been entitled to receive, or which the employee would have been entitled to receive,
(1)  reduced as in section 51, from the month following the death, even if the pensioner or employee dies before 65 years of age;
(2)  not reduced as in section 51 if, at the time of death of the pensioner or employee, their spouse is not entitled to a pension under the Act respecting the Québec Pension Plan (chapter R-9).
The pension computed under subparagraph 2 of the first paragraph may not exceed 66 2/3% of the pension that the pensioner was receiving or would otherwise have been entitled to receive, or that the employee would have been entitled to receive, after the reduction provided for in section 51.

(1)  reduced as in section 51, from the month following the death, even if the pensioner or employee dies before 65 years of age;
(2)  not reduced as in section 51 if, at the time of death of the pensioner or employee, his spouse is not entitled to a pension under the Act respecting the Québec Pension Plan (chapter R-9).
