72. Whenever a person is arrested for an infringement contemplated in section 71, the policeman in charge of the station where such person is brought may, of his own authority if the person has been arrested without a warrant of arrest having been issued for such purpose, or with the authorization of the justice of the peace who signed the warrant of arrest, if such person has been arrested under such a warrant, permit such person to sign, with or without bail, or with a deposit, an undertaking to appear, within such delay as he determines, before the competent court, in default whereof the bail shall be forfeited or the deposit confiscated, and any justice of the peace may then order the arrest of such person.
