71. Notwithstanding any inconsistent provision in the charter of a municipality, no person shall be arrested for an infringement of the Cities and Towns Act (chapter C-19), the Municipal Code (chapter C-27.1), the charter of a municipality or a municipal by-law unless a warrant has been issued for that purpose by a justice of the peace.
Nevertheless any municipal policeman may arrest without a warrant any person whom he finds disturbing public peace, order, health or safety contrary to a municipal by-law.
Every person arrested by a municipal policeman for an offence contemplated in this section shall be brought without delay before the competent court.
