Section 27 Disposition versions

27. Every person who has obtained, contrary to the provisions of the agreement, a contract to carry out work falling within any category mentioned in the agreement is liable to a penalty equal to 5&%percnt; of the contract price.

The penalty may be recovered upon proceedings instituted in accordance with section 28, provided there is no other sanction and there are no other proceedings. It may be recovered by the Corporation following a resolution of the council.

27. Every person who has obtained, contrary to the provisions of the agreement, a contract to carry out work falling within any category mentioned in the agreement commits an infraction of this act and is liable to a fine equal to 5% of the contract price.

The fine shall be recoverable upon an action instituted in accordance with section 28, but the fine cannot be imposed except to the exclusion of any other penalty or proceeding.
