C-8.2 - Act respecting childcare centres and childcare services

5. The Minister may issue a day care centre permit or a nursery school permit to any person who
(1)  applies therefor in writing to the Minister and provides the information and documents required by regulation;
(2)  undertakes to provide educational childcare which promotes the physical, intellectual, emotional, social and moral development of children in accordance with the program prescribed by regulation;
(3)  (subparagraph repealed);
(4)  pays the fees fixed by regulation; and
(5)  fulfils the other conditions prescribed by this Act and the regulations.
However, the Minister may not issue a day care centre permit or a nursery school permit to a school board.

This section, to the extent that it relates to nursery schools, comes into force on the date fixed by the Government and, to the extent that it relates to stop over centres, comes into force on the date fixed by the Government (1996, c. 16, s. 82; 1997, c. 58, s. 141).
5. The bureau may issue a day care centre permit or a nursery school permit to any person who
(1)  applies therefor in writing to the bureau and provides the information and documents required by regulation;
(2)  undertakes to provide day care to children;
(3)  undertakes to offer children a programme of activities which promote their physical, intellectual, emotional, social and moral development;
(4)  pays the fees fixed by regulation; and
(5)  fulfils the other conditions prescribed by this Act and the regulations.
However, the bureau may not issue a nursery school permit to a school board or to a private educational institution within the meaning of the Act respecting private education (chapter E-9.1).
A natural person, partnership or profit-seeking legal person holding a permit issued under this Act may not be issued any other permit under this Act.

This section, to the extent that it relates to nursery schools, comes into force on 31 December 1997 and, to the extent that it relates to stop over centres, comes into force on 31 December 1998 (1996, c. 16, s. 82).

5. A nursery school permit shall only be issued to
(1)  a cooperative;
(2)  a non-profit corporation whose board of directors is composed in the majority of parents of children who are or will be registered at that nursery school;
(2.1)  a non-profit corporation other than a non-profit corporation contemplated in subparagraph 2;
(3)  a municipal corporation; or
(4)  a person, when the applicant does not hold any other permit issued under this Act.
The applicant for a nursery school permit shall undertake to provide children with a programme of activities to promote their physical, intellectual, emotional, social and moral development, and must, in addition, fulfil the other conditions provided by this Act or the regulations.
