40. Every member of the Council present at a meeting he is not presiding and who is entitled to vote on a matter must vote on that matter unless he is disqualified to vote under the Act respecting elections and referendums in municipalities (chapter E-2.2) by reason of his interest in the matter.

40. Subject to section 29, every member of the Council present at a meeting must vote, unless he is the chairman of the executive committee or the chairman or vice-chairman of the Council and unless he is prevented from voting by reason of his interest in the matter concerned under the Act respecting elections and referendums in municipalities (chapter E-2.2).

40. Subject to section 29, every member of the Council other than its chairman, its vice-chairman and the chairman of the executive committee who is present at a meeting must vote. However, no member of the Council shall vote on any matter in which he has a direct pecuniary interest either through himself or through a partner; the acceptance of or requisition for services made available to the public according to an established tariff shall not be deemed a direct pecuniary interest.
In case of dispute, the Council shall decide whether the member has a personal interest in the matter, and such member shall not vote on the matter of his interest.
