261. On the day of the polling, no person shall, within the limits of a ward where any polling-station is open, under penalty of being guilty of an offence triable summarily and being liable to a fine of fifty dollars and imprisonment for not more than three months upon failure of payment thereof, either sell for a price in money or in exchange for any article whatsoever, or lend or deliver, or gratuitously supply any quantity whatever of alcoholic beverages, except for the use of the sick; and in the case of such exception, the burden of proof shall be upon the accused. Moreover, such beverages may only be sold, lent, delivered or supplied upon the certificate of a physician or of a priest or minister of some religious denomination.
Whosoever shall give or deliver a false certificate in respect thereof shall be guilty of an offence triable summarily and be liable to a fine of fifty dollars, and, on failure to pay the same, to imprisonment for not more than one month.
