163. (1)  The returning officer shall require the person, or one or more of the persons, producing or filing any such nomination paper, to make oath before him that he knows that the several persons who have signed such nomination paper or have made their marks thereon, are electors entitled to vote, and that they have signed or have made their marks thereon in his or their presence, and that the consent of the candidate has been signed in his or their presence, or that the person named as candidate is not in the municipality.
(2)  Such oath may be in form 10, if the office of mayor be in question, and in form 11, if that of councillor, and the fact of its having been taken shall be stated on the back of the nomination paper.
