47. For the purposes of sections 44 and 46, a non-resident is a natural person who resides in Canada for fewer than 183 days a year, a legal person constituted or continued elsewhere than in Canada or any legal person controlled by such a natural person or legal person.
A voting share held jointly is deemed to be held by a non-resident if at least one of the joint holders is a non-resident.

47. Every person who contravenes section 43 or 45 is liable to a fine of $5 000 to $50 000.
Where a corporation is guilty of an offence contemplated in the first paragraph, the director or officer of the corporation who ordered, authorized or advised the commission of the offence or who consented thereto is party to the offence.

47. Any insurance company and any director or other officer of an insurance company who authorizes or orders a transfer or allotment of shares contrary to section 43 or 45 or consents thereto is guilty of an offence and is liable on summary proceeding to a fine of at least $5,000 and not more than $50,000.
