44. A victim who, at the time of the accident, is regularly unable to hold any employment for any reason whatever except age is not entitled to an income replacement indemnity.

44. The victim who sustains injury, disfigurement, dismemberment, suffering or a loss of enjoyment of life in an accident is entitled to a lump sum indemnity in a prescribed amount and according to prescribed terms and conditions. The sum shall in no case exceed $20 000.
Where no amount is prescribed for a bodily injury, the Régie shall establish one, using as guidelines, if appropriate, the sums prescribed for similar bodily injuries.
