Act respecting the Conseil supérieur de l’éducation


WHEREAS every child is entitled to the advantage of a system of education conducive to the full development of his personality;
Whereas parents have the right to choose the institutions which, according to their convictions, ensure the greatest respect for the rights of their children;
Whereas persons and groups are entitled to establish autonomous educational institutions and, subject to the requirements of the common welfare, to avail themselves of the administrative and financial means necessary for the pursuit of their ends;
Whereas it is expedient, in accordance with these principles, to establish, as a think tank dedicated to the development of a global vision of education, a Conseil supérieur de l’éducation to collaborate with the Minister of Education, Recreation and Sports and the Minister of Higher Education, Research, Science and Technology and to advise the Ministers on any matter relating to education.
1. A body, hereinafter called the “Council”, is established under the name of the “Conseil supérieur de l’éducation”.

2. The Council shall consist of 22 members.

3. Members of the National Assembly as well as persons who do not reside in Québec shall not be members of the Council or its commissions, if any.

4. The members of the Council shall be appointed by the Government, after consultation with the associations or bodies most representative of the students, parents, teachers, school board members and socio-economic groups.
The members shall be appointed on the recommendation of the Minister after consultation with the Minister of Higher Education, Research, Science and Technology.

5. Such members shall be appointed for a term not exceeding four years.
At the end of their term, members of the Council remain in office until they are reappointed or replaced.
The members shall not be appointed for a second consecutive term.

7. The Deputy Minister of Education, Recreation and Sports and the Deputy Minister of Higher Education, Research, Science and Technology are ex officio associate members of the Council, but are not entitled to vote. They may designate a substitute.
The Deputy Ministers shall send to the Council and its commissions, if any, such available information as they require.

8. The Government shall appoint a president from among the members of the Council.
The president shall exercise his or her duties on a full-time basis.

9. The function of the Council is to advise the Minister and the Minister of Higher Education, Research, Science and Technology on any matter relating to education.
For that purpose, the Council must report at least every two years to the Ministers on the state and needs of education.
The Minister of Education, Recreation and Sports shall table the report on the state and needs of education before the National Assembly within 30 days of receiving it or, if the Assembly is not sitting, within 30 days of resumption.

10. In the exercise of its function, the Council may
(1)  advise or make recommendations to the Ministers on any matter relating to education;
(2)  solicit or receive petitions, opinions and suggestions from interested bodies or groups and from the general public on any matter relating to education; and
(3)  conduct or commission studies and investigations that it considers useful or necessary for the exercise of its function.

10.1. The Council shall advise the Minister or the Minister of Higher Education, Research, Science and Technology, as applicable, on draft regulations that they are required to submit to the Council and on any matter submitted to it by them.

11. The Council may hold its meetings at any place in Québec.

12. The members of the Council and of its commissions, if any, shall receive no salary. They shall be indemnified for expenses incurred by them in attending meetings and shall receive an attendance allowance fixed by the Government.
The president shall receive a salary fixed by the Government.

13. The secretary and the other members of the personnel of the Council shall be appointed in accordance with the Public Service Act (chapter F-3.1.1).

14. The Council and its commissions, if any, shall have their secretarial office in the territory of Ville de Québec.

14.1. Not later than 30 June each year, the Council shall submit a report of its activities for the preceding fiscal year to the Minister and the Minister of Higher Education, Research, Science and Technology.

24. The Council may establish commissions to carry out its work or to examine specific issues.

29. The office of member of the Council shall become vacant if the member dies, ceases to be qualified, refuses to accept it, resigns in writing or does not attend four consecutive sittings of the Council.

REPEAL SCHEDULES

In accordance with section 17 of the Act respecting the consolidation of the statutes (chapter R-3), chapter 234 of the Revised Statutes, 1964, in force on 31 December 1977, is repealed, except the preamble, effective from the coming into force of chapter C-60 of the Revised Statutes.

In accordance with section 17 of the Act respecting the consolidation of the statutes and regulations (chapter R-3), preamble of chapter 234 of the Revised Statutes, 1964, in force on 1 November 1980, is repealed effective from the coming into force of the updating to 1 November 1980 of chapter C-60 of the Revised Statutes.
