Regulation respecting the tariff of duties, fees and costs made under the Act respecting the preservation of agricultural land and agricultural activities
Act respecting the preservation of agricultural land and agricultural activities
(chapter P-41.1, s. 80).
The amounts prescribed in the Regulation have been indexed as of 1 January 2013 pursuant to the notice published in Part 1 (French) of the Gazette officielle du Québec of 17 November 2012, page 1336. (ss. 1, 2, 3, 3.1, 3.2, 3.3)

1. An amount of $275 shall be paid by any person submitting an application to the Commission de protection du territoire agricole du Québec under sections 58 and 73 of the Act as costs for the opening of a record and costs for investigations or hearings.

1.1. A party that requests a postponement of a hearing shall, if the postponement is granted, pay to the commission the costs directly attributable to the postponement.

2. The duties for a permit for the removal of topsoil are $731 per year. ($1,460 for 2 years)

2.1. The amounts and duties prescribed in this Regulation shall be indexed on 1 January of each year on the basis of the rate of increase in the general Consumer Price Index for Canada for the 12-month period ending on 30 September of the preceding year, as determined by Statistics Canada.
The amount prescribed in section 1 and the tariff prescribed in section 2 indexed in the prescribed manner shall be reduced to the nearest dollar where they contain a fraction of a dollar less than $0.50; they shall be increased to the nearest dollar where they contain a fraction of a dollar equal to or greater than $0.50.
The tariff prescribed in section 3 indexed in the prescribed manner shall be reduced to the nearest multiple of $0.10 where it contains a fraction of a dollar in which the second figure after the decimal point is 1, 2, 3 or 4, and shall be increased to the nearest multiple of $0.10 where it contains a fraction of a dollar in which the second figure after the decimal point is 5, 6, 7, 8 or 9.
The president of the Commission de protection du territoire agricole du Québec shall inform the public, through Part 1 of the Gazette officielle du Québec and by such other means as he may consider appropriate, of the indexing calculated under this section.

3. Any person may obtain a certified copy of a document filed in the record office of the commission by paying a tariff of $7 per document (copy of a plan $13.80).

3.1. An amount of $68 shall be paid by any person who files a declaration under section 32 or 32.1 of the Act with the commission.

3.2. An amount of $72 shall be paid by any person who applies to the commission for the issue of an attestation under section 15 of the Act or an attestation under section 105.1 of the Act to the effect that a condition set out in a decision has been complied with.

3.3. An amount of $275 shall be paid by any person who applies to the commission for the issue of an attestation under section 105.1 of the Act to the effect that an order issued by the commission has been complied with.
